RECOMMENDATION

1) Approve the Partial Acceptance of Public Improvements associated with Tract Map No. 20312-1, specifically Storm Drain Line C, as complete; 2) initiate the warranty period; 3) and authorize the City Manager to execute all necessary documents on behalf of the City. body

 

FISCAL IMPACT

There are sufficient funds included in the City’s Operating Budget to support the ongoing maintenance activities associated with the storm drain improvements being accepted.

The developer received Development Impact Fee (DIF) credits based on the approved Engineer’s Cost Estimate for Storm Drain Line C. Following reconciliation of the actual eligible improvement costs, staff will return to the City Council at a subsequent meeting for consideration of the final true-up, including any necessary adjustment to the DIF credits and/or reimbursement owed to the developer.

BACKGROUND

On May 17, 2021, the Planning Commission approved an “A” Level Master Site Approval (MSA) and Tentative Tract Map No. 20312 for Falloncrest Town Square. The “A” Level MSA established the overall development framework for the approximately 100.8-acre master plan area, including the general land uses, circulation, and development pattern. Tentative Tract Map No. 20312 established the subdivision framework for the property, consisting of 10 numbered lots and six lettered lots intended to accommodate the future development of retail, commercial, office, residential, mixed-use, and park uses. The Falloncrest Town Square master plan area is generally located south of the Southern California Edison (SCE) Easement, west of East Preserve Loop, east of West Preserve Loop, and north of Pine Avenue.

In 2021, Tri Pointe Homes Holdings, Inc. acquired approximately 23.6 acres within the Falloncrest Town Square master plan area. On October 17, 2022, the Planning Commission conditionally approved a “B” Level MSA and Site Approval (SA) for Tri Pointe’s portion of the project. Building upon the broader framework established by the “A” Level MSA, the “B” Level MSA and SA established the detailed development plan for the property, including 188 attached residential units on approximately 10.9 acres, a 9.9-acre public park, and a 0.4-acre pocket park within the High Density Residential 20 (HDR 20) land use designation. The project area is generally located south of the SCE Easement, west of East Preserve Loop, east of Linden Lane, and north of Pine Avenue (Exhibit A).

Following approval of the “B” Level MSA and SA, Tri Pointe processed Tract Map No. 20312-1 as a phased final map, commonly referred to as a “dash map,” under Tentative Tract Map No. 20312. Tract Map No. 20312-1 implemented the subdivision of this phase of the larger Falloncrest Town Square development and established the lots, easements, and rights-of-way necessary to support development of the property.

As part of the Engineering Conditions of Approval for the “B” Level MSA and SA, Tri Pointe was required to design and construct the public improvements necessary to support the development, including curb, gutter, street, storm drain, domestic and recycled water, sewer, and related improvements within and along Bickmore Avenue, Linden Lane, and Pine Avenue. These required improvements included the construction of Storm Drain Line C. All costs associated with the design and construction of the required public improvements are the responsibility of the developer.

To ensure completion of the required public improvements, Tri Pointe executed a Subdivision Improvement Agreement (SIA) and posted the required securities in connection with Tract Map No. 20312-1. The SIA and associated securities were approved by the City Council on June 20, 2023 (Exhibit B).

Storm Drain Line C has been completed and is being presented for partial acceptance independently from the remaining public improvements associated with Tract Map No. 20312-1. Line C functions as a regional storm drain facility that extends beyond the limits of Tract Map No. 20312-1 and provides drainage service to multiple developments, including Tract Map No. 20369 (KB Home), all three phases of the Falloncrest development, and Tract Map No. 19055, located west of East Preserve Loop. Given that Line C is complete and currently serves multiple developments, staff recommend proceeding with its partial acceptance rather than delaying acceptance until completion of the remaining public improvements associated with Tract Map No. 20312-1.

ISSUES/ANALYSIS

The public improvement being presented for final acceptance by the City is Storm Drain Line C, as depicted in Exhibit C. The improvement has been completed in accordance with the City’s approved plans, standards, and specifications and to the satisfaction of the Public Works Inspector. All costs associated with the public improvements required as part of the Conditions of Approval for the project were fully funded by the developer.

Security for the required one-year warranty period has been submitted to the City. During the warranty period, the developer will remain responsible for correcting any defects identified within one year following the City Council’s acceptance of Storm Drain Line C. Upon final acceptance, Storm Drain Line C will become the property of the City, and the City will assume responsibility for its ongoing operation and maintenance.

Additionally, Storm Drain Line C is an eligible improvement under the City’s Development Impact Fee (DIF) program. The developer will provide the City with the required supporting documentation for all eligible costs associated with the construction of Storm Drain Line C. City staff will review and reconcile the documentation to determine the final eligible improvement costs. Following completion of the cost reconciliation, staff will return to the City Council at a subsequent meeting for consideration of the final DIF true-up, including any necessary adjustment to DIF credits and/or reimbursement due to the developer.

Accessibility

The final acceptance of Storm Drain Line C does not include improvements to pedestrian facilities or other areas subject to accessibility requirements. Therefore, there are no accessibility impacts associated with this action.
