Award a Professional Services Agreement for $362,810 to Moffatt & Nichol, Long Beach, CA, for consulting services for Environmental Compliance, Regulatory Permitting, Right of Way, and Utility Coordination for the Pine Avenue Improvements Project (ST203); and authorize the City Manager to execute all necessary documents on behalf of the City.

BACKGROUND

Pine Avenue, between Euclid and Hellman Avenues, is a master-planned facility included in the City’s Development Impact Nexus and Calculation Report, which will be a six-lane arterial roadway with a raised landscaped median. The Pine Avenue Widening and Improvement Project (“ST203”) encompasses two main components: the widening of Pine Avenue between Euclid Avenue and Johnson Avenue to the ultimate six lane configuration (“Pine Widening”) and improving the Euclid Avenue and Pine Avenue intersection (“Euclid/Pine Intersection”).  Completion of Project ST203 will enhance roadway and intersection safety, increase traffic flow, relieve traffic congestion, and improve the quality of life for the residents in the regions including south Chino area; residents of Eastvale, Ontario, and Norco. Project ST203 requires additional rights-of-way, relocation of existing utilities, changes in vertical profile, modification of intersections, new pavement and striping, provisions for new sewer, domestic water, recycled water, drainage, and water quality facilities. Construction of these new improvements will require coordination with adjacent property owners and/or review and permits from Army Corps of Engineers, Orange County Flood Control District, Caltrans, the California Department of Fish and Wildlife, and utility companies. This project will raise the profile of the low point on Pine Avenue which is prone to flood inundation and closures during heavy rains.

 

On April 5, 2022, the City Council approved an amendment with IDC Consulting Engineers, Inc. (“IDC”) for project ST203, specifically for environmental compliance, right-of-way (“ROW”), and utility relocation related to the Pine Widening. When the agreement with IDC expired on June 30, 2023, subconsultants Moffatt & Nichol and Monument ROW were engaged to ensure project continuity. On July 1, 2023, the City entered into agreements with both Moffatt & Nichol and Monument ROW to continue their previous tasks for Project ST203.  Moffatt & Nichol managed the California Environmental Quality Act (“CEQA”) and Regulatory Permitting tasks for Pine Widening, while Monument ROW managed ROW acquisition, utility relocation coordination, and potholing for both Euclid/Pine intersection and Pine Widening.

 

As noted above, Moffatt & Nichol’s original contract only included the Pine Widening effort, however, on September 28, 2023, City staff was informed by the United States Army Corps of Engineers (USACE) that a Section 408 Permit would be required for both Pine Widening as well as the Euclid/ Pine Intersection improvements. To minimize impact to USACE jurisdiction and the amount of soil export, the Pine Widening design was revised to match a previous conceptual plan approved in 2021 by the USACE. Due to this revision, and the requirement for both Pine Widening and Euclid/Pine Intersection improvements to obtain USACE Section 408 Permit, it was recommended to combine the 408 Permit environmental scope to cover both components. This additional effort requires expansion to the physical limits of the study area for the CEQA and the National Environmental Policy Act documentation and support required by the USACE for the Section 408 Permit. City staff therefore made the determination to advertise a Request for Proposals (“RFP”) for the expanded scope for both the environmental, right of way acquisition, and utility coordination related to ST203 to ensure the best pricing and quality for the City.

 

ISSUES/ANALYSIS

On November 30, 2023, Staff solicited an RFP for Environmental Compliance and Regulatory Permitting Services; ROW Acquisition; and Utility Coordination and Relocation related to project ST203. The City's RFP informed potential proposers that design work is underway, with some aspects already started and various studies either initiated or finished. Additionally, the City intended to terminate existing contracts while utilizing all information gathered to date and carrying over uncompleted tasks to this new contract. The existing agreements for ROW Acquisition, Utility Coordination, and Relocation were issued to maintain project progress while the City solicited an RFP for the remaining work. Once the new agreement is awarded, these current agreements will be closed, having reached their $50,000 threshold for City Manager authority according to the City’s Purchasing Ordinance and Procurement Guidelines. Staff received four (4) proposals which were evaluated and ranked by the following criteria:

Staff selected the proposed consultant within the guidelines of the State of California Government Code and the City’s Purchasing Ordinance. The final ranking of the firms is shown below.
