BACKGROUND

CrossPoint Church (“CrossPoint”) is located at 6950 Edison Avenue and has property configured in a manner so it has street frontage on the west side of Euclid Avenue (approximately 600-feet north of Edison Avenue).  In April 2010, the City approved an agreement with CrossPoint to allow temporarily truck trailer storage on the property fronting Euclid Avenue to provide rental income until the economy improved and the property could be marketed for its intended land use (multifamily residential) or for an expansion of the church campus.  The original agreement term ended on December 31, 2014 and was extended under the City Manager’s authority until December 31, 2017. On December 11, 2017, the City Council approved a new agreement to be recorded against the property to better document the temporary truck trailer parking authorization.  The 2017 agreement was then extended on October 15, 2019 by a first amendment, and September 7, 2021 by a second amendment, with an additional year extension approved under the authority of the City Manager per the terms of the second amendment, which brought the current expiration date to December 31, 2023.  In exchange for continuing to allow temporary truck trailer storage on the site, CrossPoint previously agreed to allow the City to use their facilities (i.e., Fellowship Hall or an equivalent space, athletic courts or fields, classrooms, tables and/or chairs as needed, and necessary storage all generally depicted in Exhibit B to the Third Amendment) for City programming and other events at no cost to the City.  The City is currently using the church facility annually for the City of Chino-Summer Camp.  The church is now requesting an additional one-year extension to continue to allow the temporary truck storage use at the location to raise additional funds with the intention to construct a two story school building on the church campus (request letter attached to this report as Attachment B).

ISSUES/ANALYSIS

CrossPoint continues to plan for the future expansion of its facilities and athletic ministry program. In their request to extend the temporary truck parking on their site, the church mentioned they are in the initial stage of adding an educational building to provide ministry for the growing number of children who are part of their ministry. The church believes the income received from the lease of the land is necessary to help fund the new building. As such, the church is requesting an extension to the existing agreement with the City. The attached amendment allows the church to continue to use the Euclid Avenue portion of their property for truck storage until December 31, 2024. CrossPoint has informed the City that they are in the process of selling the storage site to help fund the educational building.

It is important to note that all provisions from the previous agreement shall continue to apply, including CrossPoint’s obligation to allow the City to utilize the previously mentioned facilities for City programming at no cost to the City. The amendment also authorizes the City to terminate the agreement should CrossPoint sell the site or any portion of the site.  In addition, the amendment also prohibits any significant expansion of the size or intensity of the temporary truck parking use.

The City Attorney has reviewed and approved the amendment. Therefore, it is recommended that the City Council approve the Third Amendment to the agreement between the City of Chino and CrossPoint and direct the City Clerk file the executed Third Amendment with the San Bernardino Recorder’s Office.
