BACKGROUND
On August 5, 2019, the Planning Commission approved Chino Preserve Development Corporation’s application for Master Site Approval and Tentative Tract Map No. 20164, consisting of an “A” Level Master Plan and subdivision of a 54.78 adjusted gross acre project site for conveyance purposes and the future development of 388 residential units within the Low Density Residential (LDR) land use designation. The project site is generally located south of Market Street, west of Hellman Avenue, north of Legacy Park Street, and east of Discovery Park Avenue within what is commonly referred to as the Block 4 area of The Preserve Specific Plan, as depicted in Exhibit A.
Tract Map No. 20164 established nine numbered lots and twelve lettered lots for the overall Block 4 area within The Preserve. The numbered lots created separate legal parcels intended to facilitate future conveyance, ownership transfer, financing, and phased development, while serving as the planning areas for six subsequent “B” Level Tentative Tract Maps, including Tract Maps No. 20165, 20166, 20167, 20168, 20248, and 20249. These subsequent maps further refined subdivision design, development standards, and implementation of individual residential neighborhoods within the approved master-planned community.
Lennar Homes of California subsequently acquired ownership of Tract Map No. 20167, as depicted in Exhibit A, from the master developer for the purpose of implementing the approved residential development associated with the tract.
As part of the Engineering Conditions of Approval (COA) associated with the approved subdivision for Tract Map No. 20164, Chino Preserve Development Corporation was required to design and construct certain public improvements necessary to expand and support backbone infrastructure systems, including potable water facilities, roadway improvements, sanitary sewer facilities, storm drain infrastructure, and other related public improvements. Following acquisition of Tract Map No. 20167, Lennar assumed responsibility for completion of specific in-tract improvements necessary to support development of the subdivision.
To guarantee completion of the required public improvements associated with Tract Map No. 20167, Lennar executed a Subdivision Improvement Agreement (SIA) and posted the required securities for construction of the in-tract public potable water system. The SIA and associated securities were approved by the City Council on March 2, 2021 (Exhibit B). All costs associated with the design and construction of the required improvements are borne solely by Lennar; therefore, there is no direct fiscal impact to the City.
The public improvements for this project were completed in accordance with the approved plans and to the satisfaction of Public Works staff. The project reached substantial completion in October 2025. Between October 2025 and April 2026, the contractor and project manager coordinated with the City’s project engineer to address various administrative items included in the final punch list to close out the project, including as-built drawings, compaction reports, and CAD/GIS files. All outstanding punch list items have since been submitted and completed to the City’s satisfaction.
ISSUES/ANALYSIS
The public improvements to be accepted by the City of Chino, as described above, consist of the in-tract potable water system as shown on Exhibit C. The public improvements completed have been constructed in compliance with the City’s standards and specifications to the satisfaction of the Public Works Inspector. All public improvements that were part of the COA for this project were fully funded by the developer.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain.
