Duncan Splash Pad Project (PK253); 2) authorize expenditures of up to $8,000 for project contingencies for a not-to-exceed potential contract amount of $88,000; 3) appropriate $13,000 to the Park Fund with a backfill from the Park Fund Preserve 341 reserves for a revised project budget of $88,000; and 4) authorize the City Manager to execute the necessary documents on behalf of the City.

BACKGROUND
Lewis Operating Company is currently in the development of a 10+ acre public park named Glenn E. Duncan Park located in The Preserve. This park is being developed as part of the Town Center block project, located south of Market Avenue and east of Main Street as conditioned by the Preserve Development Agreement. The developer is required to design and construct the park in lieu of paying development impact fees.
City staff proposed adding an interactive water feature to the park's amenities, as there is currently only one splash pad in the northern section of Chino. The developer has the right to reasonably decline any of the amenities requested by staff. Although the developer declined this request for liability reasons, they agreed to allocate an area within the park plans for the City to construct the water feature.
On November 9, 2023, City Staff met with the City Council's Infrastructure Streets Committee to discuss the proposal to use Park Fund Preserve Reserves for the City to construct an interactive water feature.
As part of the partnership between Lewis and Chino, the City will work on the design and development of the interactive water feature in an area of the park that both parties have selected and agreed upon. This project aims to create a visually engaging, safe, and accessible water play area that enhances the park's recreational offerings. Once constructed, the City will maintain and program this highly anticipated park amenity.
Sitescapes, Inc. was selected through a Sole Source Professional Services Agreement for the interactive water feature project as they are currently the landscape architecture firm working for Lewis Operating Corporation on the ten (10) acre park. The selection of Sitescapes Inc., as the landscape architect for the City’s project is beneficial based on their prior work on the development by Lewis Operating Corporation. Their familiarity with the site, local environmental conditions, and regulatory requirements ensures consistency in design, efficiency in project execution, and seamless integration with the existing landscape. Additionally, their previous work has demonstrated high-quality results, reducing risks associated with hiring a new firm unfamiliar with the area. Utilizing Sitescapes, Inc. will maintain design continuity, expedite approvals, and optimize cost efficiency, making them the most suitable choice for this project.
ISSUES/ANALYSIS
Staff is recommending that City Council authorize a Professional Services Agreement in the amount of $80,000 to Sitescapes, Inc., Costa Mesa, CA for the design services of the Glenn E. Duncan Park Splash Pad. In addition to the contract amount, staff is requesting to spend up to $8,000 for contingencies for unanticipated works, bringing the total potential contract to $88,000. This request requires appropriation of $13,000 to the Park Fund 340 with backfill from the Park Fund Preserve reserves for a revised project budget of $88,000.
