RECOMMENDATION
1) Approve Vesting Parcel Map No. 20561; 2) approve the Subdivision Improvement Agreement with Majestic Chino Flight, LLC, a Delaware limited liability company; 3) approve the Development Impact Fee Construction Credit/Reimbursement Agreement with Majestic Chino Flight, LLC a Delaware limited liability company for the construction of master-planned facilities associated with Vesting Parcel Map No. 20561; and 4) authorize the City Manager to execute all necessary documents on behalf of the City.

FISCAL IMPACT
Credits issued to the developer will be deducted from the actual eligible project costs once the final cost accounting has been reviewed and approved by the City Engineer and Public Works team. Upon the final acceptance of the public improvements by the City Council, staff will continue to monitor the fund balance in the appropriate Development Impact Fee Fund and begin making progress payments to the developer until the terms of the agreement are fulfilled. Each progress payment will require an appropriation of funds and therefore, each payment will be brought back to the City Council for approval.

BACKGROUND
Majestic Chino Flight, LLC (“Developer”) has a long-term lease with the County of San Bernardino (“County”) to develop property located adjacent to the Chino Airport at the southeast corner of Flight and Remington Avenues (Exhibit A). The project site is located within a larger master-planned industrial development.
On March 20, 2023, the Planning Commission approved the Developer’s applications for Site Approval, Special Conditional Use Permit, and Vesting Tentative Parcel Map No. 20561 to subdivide 56.95 acres of land into three parcels ranging in size from 3.74 acres to 46 acres. Parcel 1 is proposed to be developed with a 925,362-square-foot industrial building with loading doors facing Remington Avenue, while Parcels 2 and 3 fall within the Chino Airport Runway Protection Zone and will remain undeveloped. These two parcels will be graded and landscaped.
The applicant subsequently requested a time extension for Vesting Tentative Parcel Map No. 20561. On March 18, 2026, the Planning Commission approved the extension, allowing additional time for completion of the final map and associated agreements related to the Chino Flight project.
The Engineering Conditions of Approval (COA) for this development requires public improvements including, but not limited to curb, gutter, sidewalk, streetlights, asphalt concrete pavement, landscape, traffic signal modification, sewer, water, and drainage improvements on Flight and Remington Avenues. To guarantee the completion of these public improvements, the Developer is required to enter into a Subdivision Improvement Agreement (SIA) (Exhibit B) and obtain the necessary securities for the improvements. All required improvements shall be constructed at the sole cost and expense of the Developer.
Additionally, certain required public improvements are master-planned facilities identified in the City’s Preserve Development Impact Fee (“DIF”) program. The DIF Ordinance provides that when, as a condition of approval for a development project, a developer constructs a public facility identified in the DIF Nexus and Calculation Report, the developer may be eligible to receive reimbursement and/or fee credits toward the applicable DIFs imposed on the development project. Accordingly, a Construction Credit and Reimbursement Agreement is required.
ISSUES/ANALYSIS
The requirements established at the time of tentative map approval will be satisfied through execution of the SIA for Vesting Parcel Map No. 20561, along with the posting of the required securities to guarantee completion of the public improvements.
Upon final acceptance of the public improvements, the Developer will submit supporting documentation to the City. The City Engineer and Public Works Team will review the final accepted “as-built” plans, specifications, and supporting documentation to determine which costs are eligible for DIF credit and/or reimbursement in accordance with the terms of the DIF Construction Credit and Reimbursement Agreement (Exhibit C). Once the final cost accounting is approved, staff will return to the City Council to request appropriation of funds necessary for progress payments and to apply the approved DIF credits issued to the Developer for Vesting Parcel Map No. 20561 until all obligations under the agreement have been fulfilled.
