BACKGROUND
The City Council adopted the current Citywide Legislative Policy on October 18, 2022. The policy provides for a City Council subcommittee entitled the Legislative Policy Committee (LPC), which consists of two City Council members that are appointed and assigned when Council committee assignments are determined, generally in December of even numbered years, and serve until the committee assignment list is modified and approved by Council.
The LPC is a Brown Act body with continuing subject matter jurisdiction, published agendas, and meetings held in a publicly accessible facility. Meetings are currently held on an “as-needed” basis, with staff, and often the City’s consultants, providing presentations, updates, and recommended City positions on legislative and policy proposals.
Currently, the LPC may approve these recommendations or direct staff as it deems necessary.
ISSUES/ANALYSIS
On occasion, legislation is amended, new bills come to the City’s attention, or existing bills move quickly through the process, requiring the City to weigh in on the measure or issue in a timely manner. The current policy, which authorizes the LPC to approve official City positions as long as they align with the adopted Citywide Legislative Policy, negatively impacts the timeliness of the City’s response when the committee is not able to meet to take an official position.
The proposed amendment to the Citywide Legislative Policy authorizes City Staff to approve official City positions with the qualification that the official position is consistent with the City’s adopted legislative policy and that the Committee or City Staff report to the City Council on any positions, updates, recommendations, or actions taken at the earliest feasible upcoming regular meeting of the City Council.
The LPC discussed the policy updates at their regular meeting held on Tuesday, January 9, 2024, and recommended the proposed policy updates to the City Council for approval.
