BACKGROUND
An application was submitted by Heights Christian School (HCS) in March 2023 to amend the Eucalyptus Business Park Specific Plan (EBPSP). The EBPSP Amendment (PL23-0057) includes a request to allow community education for minors as a conditionally permitted use in the Commercial Office (C/O) land use designation and to establish the required off-street parking requirements for this type of school use. In addition, HCS also submitted PL23-0058 for a Special Conditional Use Permit (SCUP) concurrently with the EBPSP Amendment to establish a private school in an existing 14,172 square foot building on the existing Verve City Church campus located at 14670 Ramona Avenue. On November 15, 2023, the Planning Commission recommended approval of the EBPSP Amendment (PL23-0057) and approved the SCUP (PL23-0058) to establish the proposed school (6-0 vote), contingent on the approval of the EBPSP Amendment by the City Council (Planning Commission Staff Report attached as Exhibit “A”).
ISSUES/ANALYSIS
The EBPSP classifies school uses into two categories: 1) community education for adults; or 2) community education for minors. Currently, the EBPSP allows community education for adults in the Business Park (BP), Commercial (C) and C/O land use designations, with an Administrative Approval. Community education for minors is only permitted in the C land use designation subject to an approval of a SCUP. The City’s Zoning Code conditionally permits schools regardless of age in the Commercial General (CG) and Commercial Office (CO) zoning districts, which is equivalent to the C and C/O land use designations of the EBPSP. The proposed EBPSP Amendment would allow community education for minors in the C/O land use designation with the approval of a SCUP and is consistent with how the use is permitted elsewhere in the City. An amendment to the off-street parking requirements of the EBPSP is also proposed to establish off-street parking requirements for this type of school use. The proposed parking standard would require two parking spaces per classroom, consistent with the off-street parking requirements for elementary and secondary schools in the City’s Zoning Code.
