BACKGROUND
The applicant, Rizk Buildings at Chino LLC, is requesting approval of a Special Conditional Use Permit (SCUP) to operate a paint and auto body repair business (Fix Auto) within a 9,964 square foot industrial single tenant building located at 4510 Carter Court. Pursuant to Chino Municipal Code § 20.07.030(A), a SCUP is required to establish a new paint and auto body repair shop within the M1 (Light Industrial) zoning. The applicant currently operates two Fix Auto locations in the surrounding area which have been in business since 2007.
ISSUES/ANALYSIS
Business Location/Operation:
Fix Auto is a paint and auto body repair chain that has been in operation for over 24 years and offers a variety of services including collision repair, dent repair, paintless dent removal, and windshield repair. The proposed location will offer services limited to express and cosmetic vehicle repairs. The location will accommodate up to 15 vehicles at any given point. Vehicles are anticipated to be on-site for an average duration of eight to ten days. The proposed hours of operation are Monday through Friday, 8:00am to 5:30pm, with the business being closed Saturday and Sunday. Fix Auto anticipates having six employees on-site: one customer service representative, one repair manager, one manager, one body technician, one painter, and one shop helper.
The existing building is currently designed with the customer entry on the western side of the building, facing Ramona Avenue. Vehicles that are to be serviced will be brought in through a roll up door on the east side of the building. All repair work will be conducted within the building. The building is designed with 17 parking stalls inside the building for security purposes to accommodate the overnight storage of vehicles. The site also includes a secured yard area on the north side of the building which also allows for secure overnight storage of vehicles if necessary. This also allows vehicles to be fully screened from public view when the business is closed.
Land Use Compatibility
The proposed use is within a single-tenant industrial building. The property is bordered by industrial uses to the south and east and a self-storage facility to the north. A residential neighborhood is located on the west side of Ramona Avenue, with the closest residential structure approximately 146 feet away from the proposed use. All auto repair work is to be conducted within the interior of the building to minimize nuisances to surrounding businesses and property owners.
Parking
The subject tenant space is 9,964 square feet. Of that square footage, 1,500 square feet will be dedicated to office use and 8,464 square feet will be dedicated to paint and auto body repair. Based on the division of space, the use requires a minimum of 35 parking spaces. A total of 37 parking spaces are proposed, including the 17 parking stalls within the building, which meets the parking requirements.
Public Noticing
A 10-day notice was mailed to all property owners within a 300-foot radius of the project site. In addition, a notice was published in the Chino Champion on February 10, 2024, and the City sent information out on the City’s social media platforms. In response to the public notice, no comments have been received. The notice exceeds legal noticing requirements.
ENVIRONMENTAL REVIEW
The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per Section 15301 of the guidelines-Existing Facilities.
