1) Accept public improvements as complete for Site Approval PL20-0026; 2) authorize release of the performance bond and initiate the warranty bond; and 3) authorize the City Manager to execute the necessary documents on behalf of the City.

BACKGROUND

Yorba XC, LLC (developer) entered into an agreement with the Chino Valley Unified School District (CVUSD) to construct the district’s new administrative office building in exchange for a long-term ground lease on an adjacent piece of industrial property to the east, owned by CVUSD. Subsequently, the developer submitted applications to develop two separate sites in accordance with the agreement. Project PL20-0026 (Site Approval) is for the construction of a two-story administrative office building that was built at 13461 Ramona Avenue. Project PL20-0029 (Site Approval) is the second site, which involves the construction of a speculative warehouse/distribution building at 13404 Yorba Avenue.

 

The Engineering Conditions of Approval (“COA”) for this project required the developer to design and construct certain public improvements on Ramona Avenue including, but not limited to, sidewalk, curb ramps, crosswalks, flashing beacons, asphalt concrete overlay, driveways, streetlights, parkway landscaping, signing and striping, storm drain, sewer, fire hydrants and domestic water. The public improvements completed by the developer necessitated the execution of a Public Improvement Agreement and posting securities that the City Council approved on July 5, 2022 (Exhibit 1). It should be noted that the costs associated with the design and construction of the required public improvements are completely offset by the applicant. There is no direct fiscal impact on the City.

The conditions of approval required the owner annex the property to the City’s Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 90) for public streetlight maintenance along the project’s frontage, within the right-of-way.

 

On June 7, 2022, the City Council approved Resolution 2022-031, which declared the City’s intention to annex the property into Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 90) and, approved the Engineer’s Report, which estimates the annual assessment to be levied from the property for streetlight maintenance. By way of ballots mailed to the property owner(s), the property owner(s) are requested to register their support or protest for the annexation to Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 90). On September 6, 2022, the City Council held a public hearing and approved Resolution 2022-055 ordering the annexation into the Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 90).

The public improvements associated with this project have been completed in accordance with the approved plans and to the satisfaction of the City Engineer. The overall project reached substantial completion in December 2024.

Between June and December 2024, progress on certain street improvements was delayed due to overlapping construction activities associated with a separate Capital Improvement Program (CIP) project along Ramona Avenue. This overlap impacted the completion timeline for several items identified in the original final punch list issued in June 2024.

Following the completion of the CIP improvements on Ramona Avenue, an updated punch list was issued to the developer in February 2025. From February through May 2025, the contractor coordinated with the Public Works inspector to complete the remaining punch list items. All outstanding work has since been addressed to the City’s satisfaction.

 

ISSUES/ANALYSIS

The public improvements being accepted by the City of Chino, as described above, are included as shown on Exhibit 2. The public improvements completed have been constructed in compliance with the City’s standards/specifications, including accessibility requirements, and to the satisfaction of the Public Works Inspector. All public improvements that were part of the COA for this project were fully funded by the developer. 

Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain. The following maintenance obligations will commence following acceptance of the public improvements:
