BACKGROUND
As a part of the College Park Development’s conditions of approval, off-site improvements alongside Edison Avenue impacted existing off-site drainage facilities, including the Magnolia Channel, requiring mitigation measures to address those impacts. The Magnolia Channel, located between Satterfield Way and Appalachian Street, is a man-made, earthen drainage channel that receives stormwater flows from the City's storm drain system and ultimately conveys water to the Santa Ana River. The California Department of Fish and Wildlife required the creation of native habitat including freshwater marsh and grassland within and adjacent to the Magnolia Channel.
Since the City's acceptance of the required public improvements, the City of Chino has been responsible for the ongoing operation and maintenance of the Magnolia Channel. Routine maintenance is necessary to preserve the channel's hydraulic capacity, facilitate the continuous conveyance of stormwater, minimize standing water, and reduce conditions that may contribute to mosquito breeding. Maintenance activities include vegetation management, sediment and debris removal, and invasive species control.
To perform these activities, the City operates under Streambed Alteration Agreement No. 1600-2020-0096-R6 with the California Department of Fish and Wildlife (CDFW), which is effective through July 9, 2032. The agreement establishes measures to protect fish and wildlife resources and requires the City to conduct biological monitoring and reporting services associated with maintenance activities. These requirements include pre-maintenance nesting bird surveys, nesting bird monitoring and reporting, annual maintenance reports, and long-term status reports submitted to CDFW.
Since the execution of the Streambed Alteration Agreement with the CDFW in 2020, Glenn Lukos Associates, Inc. has provided the biological monitoring, environmental compliance, and reporting services necessary to support the City's obligations under the Agreement. These services have enabled the City to perform routine maintenance activities within Magnolia Channel while maintaining compliance with California Department of Fish and Wildlife requirements.
ISSUES/ANALYSIS
Glenn Lukos Associates, Inc. has provided the biological monitoring and reporting services required under the City’s Streambed Alteration Agreement and possesses extensive knowledge of the Magnolia Channel mitigation site, permit requirements, historical monitoring activities, and reporting obligations. Annual maintenance reports and long-term status reports required by the California Department of Fish and Wildlife are based on data and observations collected over multiple years. As a result, transitioning these services to another consultant would require significant time for project familiarization, review of historical monitoring records, and coordination with regulatory agencies.
Continuing services with Glenn Lukos Associates, Inc. ensures consistency in monitoring methodologies, reporting, and regulatory compliance while minimizing the potential for delays or disruptions to the City's maintenance activities. In accordance with Chapter 3.32 of the Chino Municipal Code, staff is recommending a noncompetitive procurement for these specialized professional services to provide continuity of operations and support the City's ability to efficiently meet its obligations under the Streambed Alteration Agreement.
Staff recommends that the City Council award a Professional Service Agreement with Glenn Lukos Associates, Inc. in the amount of $196,260 for a five-year term for Magnolia Channel Biological Monitoring and Reporting Services.
