RECOMMENDATION

1) Accept the Kimball Avenue Median Improvement Project (G7241), with Metrocell Construction, Inc., Contract No. 2024-267 as complete; 2) authorize the Director of Public Works to file the Notice of Completion on behalf of the City of Chino; and 3) authorize the release of retention funds following the 35-day lien period.

FISCAL IMPACT

The project was completed within the City Council approved budget.

Following release of retention funds, the City will invoice the County of San Bernardino for reimbursement of all applicable contract expenses per terms of the American Rescue Plan Act (ARPA) Sub-recipient Agreement No. 2024-285 in the amount of $277,679.50.

BACKGROUND

In 2022, a raised median was constructed on Kimball Avenue in accordance with the Preserve Specific Plan as part of the Altitude Business Centre improvements which included the In-N-Out distribution center.

In early 2023, representatives for the commercial center located at the southeast corner of Euclid Avenue and Kimball Avenue approached the City of Chino regarding means to enhance westbound access to their commercial business site. The commercial center owner expressed a concern to the City that the lack of access for westbound traffic negatively impacts the businesses in the center.

On June 12, 2023, the request to investigate added access to the commercial center from westbound Kimball Avenue was brought to the City Council Infrastructure Streets Committee for further discussion. The Committee supported a request for the City to investigate and develop a cost estimate for a left-turn pocket to be installed within the newly constructed median to facilitate westbound access. It was noted that funding for the work would require a reimbursement agreement between the City and the commercial center representatives. Staff was directed to provide the commercial center representatives an estimated cost to implement the improvements.

The City prepared a conceptual layout for the left-turn pocket and obtained three estimates from qualified contractors. With an estimated cost to construct, the representatives explored cost-sharing options with the City and ultimately reached out to the San Bernardino County Board of Supervisors’ office to seek other funding opportunities. The City also submitted a letter of support for consideration of funding the left-turn pocket to 4th District County Supervisor Curt Hagman’s office.

In review of the request, the County Board of Supervisor’s Office identified the need to include a second turn pocket along Kimball Avenue serving access to the Chino Airport hangar owned by San Bernardino County. Through a collaborative effort, Supervisor Curt Hagman requested the use of San Bernardino County’s American Rescue Plan Act (ARPA) allocation to fund median improvements at both locations on Kimball Avenue as infrastructure improvements to assist struggling businesses. The funding request was for $314,324 for the design, construction, and inspection of the two left-turn pockets.

On March 8, 2024, a formal Notice Inviting Bids was released. On March 28, 2024, two bids were received and opened. On May 21, 2024, City Council awarded a construction contract to Metrocell Construction Inc., for $250,399.40 and authorized up to $25,040 (10% of the contract amount) for construction contingencies. At the same meeting, City Council approved entering into an ARPA sub-recipient agreement with San Bernardino County for the design and construction phase of the two left-turn pockets in the amount of $314,324. On July 10, 2024, the agreement was executed with the County.

ISSUES/ANALYSIS

All work has been completed per the terms of the original contract and approved change order. City-staff initiated a change order to reconcile quantities constructed, which reduced the total contract amount by $9,142.90. Prior to construction, it was brought to the County’s attention that work is required on Chino Airport hangar property to utilize the requested left-turn pocket. Currently, due to the elevation difference between the Chino Airport hangar parking lot and the newly constructed drive approach, left-turn movements into the hangar are temporarily restricted.  For the Airport drive approach to allow this movement, additional grading and repaving of the parking lot on County owned property is required. The County was not able to procure a contractor to complete their on-site work prior to completion of the City’s project and has therefore approached the City to perform the additional work on their behalf. City staff are currently coordinating with San Bernardino County staff on a reimbursement agreement wherein the County would reimburse the City for this additional work. The additional work would be performed under a separate contract and City staff will bring this agreement to City Council at a future meeting.

Metrocell Construction Inc. has complied with the terms of the contract. A Notice of Completion has been prepared for filing with the San Bernardino County Recorder’s Office. The retention funds will be released following the 35-day lien period.
