RECOMMENDATION

Award a Professional Services Agreement with Carpenter, Rothans & Dumont, LLP for $218,000 over a five-year term for legal services; and authorize the City Manager to execute all necessary documents on behalf of the City.

BACKGROUND

The City of Chino periodically retains outside legal counsel to supplement in-house legal resources and to provide specialized expertise in the area of law enforcement matters. These services may include, but are not limited to, litigation support, regulatory compliance, advisory opinions, and representation in matters requiring subject-matter specialization. Carpenter, Rothans & Dumont, LLP (CRD) is experienced in municipal law and other practice areas that support the City’s operational and legal needs.

ISSUES/ANALYSIS

The City requires reliable and qualified legal counsel to address a range of legal matters that arise during City operations. While the City Attorney’s Office provides primary legal support, certain matters specific to the Police Department may require specialized expertise. CRD’s existing knowledge and representation of the City makes continuity of counsel necessary to avoid disruption and a transition of case knowledge that could be detrimental to the City’s best interests. Contracting with CRD allows the City to:

 

                     Access specialized legal knowledge and experience;

                     Maintain continuity and consistency in legal representation; and

                     Manage risk by obtaining expert legal guidance in areas that may expose the City to liability.

Staff recommend the City Council award a sole-source professional services agreement with Carpenter, Rothans & Dumont, LLP in the amount of $218,000 to continue providing specialized legal representation to the City. Sufficient funds for this agreement have been included in the Fiscal Year 2026-27 Adopted Budget and will be budgeted in future proposed Fiscal Year Operating Budgets.
