Approve contract amendment No. 4 with TAIT & Associates, Inc. Contract No. 2022-196 for $83,194 for a not to exceed contract amount of $167,834 for engineering design services related to Project SN221 and authorize the City Manager to execute all necessary documents on behalf of the City.

FISCAL IMPACT
Sufficient funds are budgeted in the Fiscal Year 2025-26 Capital Improvement Program (CIP) for the Alley/Sanitation Rehabilitation FY21-22 Various Locations (SN221). The funding for Contract Amendment No. 4 is available within the Sanitation Fund (Fund 550) under the City's trash services contract for alley maintenance activities.

BACKGROUND
As part of the Capital Improvement Program (CIP), staff assessed various alleys to determine and establish a plan to improve deteriorating conditions. Staff determined two (2) alleys running east and west (Alleys 20 & 21), between B Street and D Street from Central Avenue to Benson Avenue that require repairs. Repairs consist of rehabilitation of alley pavement, and reconstruction of alley approaches, sidewalks, curbs, and gutters to comply with the Americans with Disabilities Act (ADA).
On November 16, 2021, the City Council awarded a Professional Services Agreement to TAIT & associates, Inc. Santa Ana, CA (TAIT) for Engineering Design Services for Project SN221 for a not-to-exceed amount of $84,640. Council additionally approved a design contingency budget of $8,464. Amendments No. 1, 2, and 3 were executed to extend the term of the agreement for additional fiscal years.
ISSUES/ANALYSIS
The original design scope for the alley rehabilitation included grinding off existing asphalt and overlaying the existing alley pavement with new asphalt. The scope also included a constructability review at the 30-percent design stage to compare costs between the replacement of existing drainage gutters and construction of new ribbon gutters within the alley. It should be noted that the project was placed on pause after the 30-percent design was completed to assess the condition of the waterlines beneath the alleys. A subsurface utility investigation concluded that no aging steel waterlines exist beneath the footprint of the project, therefore the project may proceed without rehabilitation of the water utilities. Upon completion of a constructability review and geotechnical report recommendations, staff determined that the construction of ribbon gutters and a full depth replacement of alley pavement is necessary. As a result, the project scope would expand to address these additional conditions. Amendment No. 4 captures the expanded scope needed to complete the construction plans and specifications to staff satisfaction.
Tait & Associates, Inc. will continue working on behalf of the City to address constructability review comments, including modifications to avoid relocation of above-ground infrastructure such as streetlights and fire hydrants. Additionally, the expanded scope includes revisions to the design of pavement treatment to include full reconstruction and add alley ribbon gutters to improve drainage during rain events. Necessary surveying updates are required to tie-into the north and south alleys resurfaced under Project SN211, completed in March 2023. With these revisions incorporated into the bid set, the project is anticipated to be ready for construction advertisement in first quarter 2027.
Staff recommend the City Council approve Amendment No. 4 with TAIT for $83,194 with a not to exceed revised contract amount of $167,834 for the expanded scope needed to complete the construction plans and specifications for Project SN221.
