BACKGROUND
Calvary Chapel Chino Hills Foundation, located at 4201 Eucalyptus Avenue (see Exhibit A), proposed to build a new accessible pedestrian sidewalk on the north side of Eucalyptus Avenue. The sidewalk was intended to extend from Appian Way to approximately 517 feet east of the intersection. This project aimed to improve pedestrian access to the church from a nearby industrial property, which has been used frequently as an overflow parking lot by parishioners.
In December 2022, the Development Services Department approved an Engineering Cost Estimate provided by Calvary Chapel for the design and construction of the sidewalk. The City also required the installation of traffic interconnect conduit and pull box improvements on Eucalyptus Avenue be made alongside the sidewalk installation to enable the future extension of the existing fiber network, which is expected to connect to the Ramona Avenue signalized intersection with a future project. On February 21, 2023, Calvary Chapel entered into a Public Improvement Agreement with the City and posted the necessary securities to ensure timely completion of the public improvements on Eucalyptus Avenue (Exhibit B).
The contractor, Bergman KPRS, LLC, constructed the public improvements on behalf of Calvary Chapel Hills Foundation. All public improvements were completed in September 2023 and a construction punch list was generated to initiate the closure of the project. During the construction phase, the builder borrowed City traffic equipment to complete the project and it was replaced in kind in January 2024. Additionally, City staff coordinated with the developer’s engineer to complete the project closeout process which included finalizing the as-built drawings that occurred in August 2024.
ISSUES/ANALYSIS
The public improvements that are being accepted by the City of Chino include a constructed 6-ft wide sidewalk, an extension of traffic signal interconnect conduit, and a pull box. The public improvements completed have been constructed in compliance with the City’s standards/specifications and accessibility requirements and to the satisfaction of the Public Works Inspector, City Engineer, and City Traffic Engineer. The public improvements were fully funded by the Calvary Chapel Chino Hills Foundation.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain.
