BACKGROUND
On October 21, 2019, the City’s Planning Commission conditionally approved Special Conditional Use Permit (SCUP) PL17-0081 and Site Approval (SA) PL17-0082, allowing Manifest Destiny Trucking Corporation (developer) to construct a 2,117-square foot office building and establish a trucking facility on 4.5 acres land located at 14085 Magnolia Avenue (Exhibit A).
As part of the Engineering Conditions of Approval requirements, the applicant is required to design and construct certain public improvements along the perimeter of Edison and Magnolia Avenues including, but not limited to, sidewalk, curb and gutter, landscaping, water and drainage improvements, street pavement, signing and striping, streetlights, and traffic signal modifications.
Along with the streetlight improvements, the Conditions of Approval required that the developer annex the property into the City’s Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 88) for public streetlight maintenance along the project’s frontage, within the right-of-way. Before the project moved forward with the construction of the streetlight improvements, the City decided to take a closer look at the existing street lighting on Edison and Magnolia Avenues by having the design engineer prepare a photometric study. Based on the study, it was determined that the existing streetlights along the project frontage were more than sufficient and met the City’s standards and lighting specifications. No additional streetlights were required; only the existing lights fronting the project must be annexed.
On November 7, 2023, the City Council approved Resolution 2023-066 ordering the preparation of an Engineer’s Report estimating the annual assessment for each parcel for lighting facility maintenance and initiating the annexation process. By way of ballots mailed to the Property owners, the property owners are requested to register their support or protest for the annexation to Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 88). The ballots will be tabulated at a public hearing held no sooner than 45 days after the ballots have been mailed, if necessary.
ISSUES/ANALYSIS
The property owner has filed the required petition to be annexed into the City’s Landscape and Lighting District, to include four (4) streetlights fronting the project on Edison and Magnolia Avenues (refer to Resolution No. 2024-001, Attachment B). The property owner has also filed with the City Clerk an assessment ballot in favor of the annexation, as per the Conditions of Approval. According to State law, if a petition to the City of Chino to undertake annexation proceedings, and an assessment ballot in favor of the proposed assessment is obtained from the property owner involved in the annexation, the City Council may complete the annexation by adopting a resolution annexing the project into the City’s Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 88).
The estimated annual assessment for this project will be $280.95 for the first year. The actual assessment will vary each year based on actual costs (i.e. maintenance and energy cost changes up to the annual Consumer Price Index for the region). The annexation and regular maintenance of these streetlights will help ensure the City continues providing excellent public service in partnership with the property owner and an overall positive City image with the completion of the required public improvements.
