BACKGROUND

On June 18, 2024, the City Council approved Amendment No. 2 to the Construction Credit/Reimbursement Agreement for the Pine Avenue Improvements - Phase 1 (Stage 1-3) & Stage 4. This second amendment was necessary to reimburse Chino Preserve Development Corporation, a Lewis Management Company (“Lewis”) for the construction of a shared use path, sidewalk, and intersection improvements as shown in Exhibit A. These improvements are necessary for safe pedestrian crossings at the intersection of Pine Avenue and West Preserve Loop. The improvements will provide residents north of Pine Avenue with pedestrian access to the newly built Town Center commercial center and the forthcoming Legacy Academy school.

A portion of these improvements will be situated on property currently owned by Lewis. Consequently, Lewis is obligated to allocate a segment of its property for public street and utility purposes. Lewis has already executed the necessary dedication documents, which have been reviewed and approved by the Public Works Engineering staff. Please see Exhibit B for details.

ISSUES/ANALYSIS

The area to be dedicated is part of the ultimate right-of-way for the south side of Pine Avenue, which Lewis would have eventually dedicated to the City as part of subdividing their adjacent property. The right-of-way dedication area exceeds one acre, necessitating City Council acceptance through either resolution or minute action, in accordance with San Bernardino County Recorder’s guidelines.
