BACKGROUND

Tract Map Nos. 19951 and 19952, as presented by Lennar Homes of California, Inc. (“Lennar”), consist of 57 single-family detached residential dwelling units on approximately 6.5 acres and 93 single family detached residential dwelling units on approximately 14.29 acres (Exhibit A) generally located at the northwest corner of Bickmore and Alpine Meadows Avenues. These tracts were conditionally approved by the City of Chino Planning Commission on June 30, 2015.

The Engineering Conditions of Approval for this tract required Lennar to design and construct certain improvements both public and private including, but not limited to, potable water lines; street improvements; sewer improvements; and storm drain improvements. The public improvements completed by Lennar necessitated the execution of Subdivision Improvement Agreements and posting securities that the City Council approved on December 18, 2018 (Exhibit B and B-1). It should be noted that the costs associated with the design and construction of the required public improvements are completely offset by the developer. There is no direct fiscal impact to the City.

Construction of the public improvements began in October 2018. The public improvements were completed by the end of July 2021. In August 2021 City staff issued a punch list describing all remaining items to be completed by Lennar before closing out the project. Lennar worked on completing punch list items for an extended time. In July 2023 Lennar reached out to have the remaining items from the punch list inspected. Final cap paving and striping were completed in January 2024. Once the punch list items were complete, staff began working with Lennar to address all remaining items for closeout, which included the submittal of documents such as as-built drawings, grading certificates, etc.

ISSUES/ANALYSIS

The public improvements completed have been constructed in compliance with the City’s standards/specifications, and accessibility requirements, and to the satisfaction of the City Engineer. The public improvements that are being accepted by the City of Chino include streets and domestic water.

All public improvements that were part of the condition of the Project were fully funded by the developer.

Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain. The following maintenance obligations will commence following acceptance of the public improvements:

                     Domestic Water:                     By the City

Public Street Sweeping:                     By the City

                     Public Streetlights:                     By the HOA

                     In-Tract Landscaping:                     By the HOA
