FISCAL IMPACT

It is expected that the approval of the proposed increase in administrative fines for violations of the City’s truck route ordinance will likely result in a short-term increase in administrative fine revenue, followed by a normalization or possible reduction in fine revenue as violators adjust to the new fine schedule and compliance increases.

BACKGROUND

Chapter 10.44 of the Chino Municipal Code establishes designated truck routes within City limits. The designation of specific truck routes is intended to protect residential neighborhoods, preserve the integrity of roadway infrastructure, and promote public safety. Currently, the administrative penalty for a truck route violation is set at $250 for the first offense, $500 for the second offense within a 12-month period, and $1000 for the third offense within the same 12-month period.

The Police Department continues to encounter repeat violators of the City’s truck route requirements, along with regular complaints regarding commercial vehicles operating on non-designated truck routes. Enforcement experience indicates that the existing fine structure has not provided a sufficient deterrent, as some commercial operators continue to disregard designated routes despite prior citations and appear to view the current fines as a minimal cost of doing business. These ongoing violations contribute to roadway deterioration, public safety concerns, and quality-of-life impacts, supporting the need for an increased administrative fine structure to promote compliance.

ISSUES/ANALYSIS

Sections 53069.4 and 36901 of the California Government Code authorize local jurisdictions to adopt administrative penalties up to $1,000 per occurrence for violations of the jurisdiction’s municipal code designated as misdemeanors. To address the increasing frequency of truck route violations described above, the following revisions to the City’s Administrative Fines schedule are being proposed:

This progressive fine structure is designed to discourage repeat violations and aligns Chino's penalty model with that of neighboring cities, including Pomona, which imposes a $1,000 fine for first-time offenses. All current administrative citation procedures, appeal rights, and collection processes, outlined in Chapter 1.15 of the City’s Municipal Code, will remain unchanged.
