RECOMMENDATION

1) Accept the Kimball Avenue Preserve Improvements Project (ST232) with C.P. Construction Co., Inc., Contract No. 2024-072 as complete; 2) authorize the Director of Public Works to file the Notice of Completion on behalf of the City of Chino; and 3) authorize the release of retention funds following the 35-day lien period.

FISCAL IMPACT

The project was completed within the City Council approved project budget. All unused project funds will be returned to the appropriate fund balances.

Following the release of the retention funds, the City will invoice the County of San Bernardino for reimbursement of all applicable contract expenses per terms of the reimbursement agreement No. 2021-209 in the amount of $907,350.

BACKGROUND

The Kimball Avenue Preserve Improvements Project (ST232) constructed “Kimball Avenue Street Improvements” and “Kimball Avenue Storm Drain Improvements” (Exhibit A) further defined below:

Kimball Avenue Street Improvements: This scope of work included improvements to widen the northern half of Kimball Avenue between Rincon Meadows Avenue and Main Street, as outlined in the Preserve Specific Plan and the City’s Development Impact Nexus and Calculation Report. The roadway was widened to provide two westbound vehicle lanes. Work included the relocation of five Southern California Edison (SCE) transmission poles and other utilities, removal and replacement of an existing chain link fence, installation of concrete curbs, establishment of two catch basins for drainage, and pavement improvements. The project was a coordinated effort involving SCE, the San Bernardino County Airport Division, Richland Communities, and various communication agencies.

Kimball Avenue Storm Drain Improvements: This scope of work included partnering with the County of San Bernardino to jointly address drainage issues impacting Kimball Avenue and the Chino Airport. Improvements included the construction of an underground box culvert connecting two existing basins located north and south of Kimball Avenue, between Euclid Avenue and Quality Way. The City served as the lead agency responsible for preliminary engineering design, surveying, right-of-way acquisition, utility relocations, and construction.

On January 19, 2021, the City Council approved Cooperative Agreement Contract No. 2021-209 with the County of San Bernardino for the Kimball Storm Drain Improvements, in the amount of $801,600, with an additional $80,160 authorized for construction contingency, for a total not-to-exceed amount of $881,760.

On July 5, 2023, the City Council awarded Construction Contract No. 2024-072 to C.P. Construction Co., Inc. for the Kimball Avenue Preserve Improvements (ST232) in the amount of $2,959,540. As the construction bid exceeded the original estimate with the County by more than 10% for the Kimball Avenue Storm Drain Improvements, the City executed an amendment to the Cooperative Agreement, to reflect the revised amount. This amended agreement was also approved by City Council on July 5, 2023. The Council additionally authorized up to $395,259 for project contingencies.

To increase the efficiency of the new box culvert system, additional drainage improvements were requested by City staff through Contract Change Order (CCO) No. 1 in the amount of $31,200. Staff executed CCO No. 1 which included adding an 18-inch reinforced concrete pipe (RCP) across Kimball Avenue adjacent to the newly established box culvert to facilitate overflow during heavy rain events or in the event of blockage to the system.

On November 5, 2024, the City Council approved CCO No. 2 with C.P. Construction Co. in the amount of $681,758.45. The City directed the contractor to expand pavement rehabilitation along both sides of Kimball Avenue, east of Main Street to Hellman Avenue. The additional scope included a 2-inch grind and overlay, new striping, re-establishment of traffic signal loops, and adjustments to water valves and utility manholes. This work excluded recently improved sections of Kimball Avenue between Flight Avenue and Hellman Avenue, completed as part of a nearby development project.

On July 17, 2025, City staff-initiated CCO No. 3 to reconcile final construction quantities, resulting in a net reduction of $184,711.08. The revised total contract amount is $3,487,787.37.

 

 

ISSUES/ANALYSIS

All work has been completed per the terms of the original construction contract and approved change orders. The following is a summary of the final accounting of construction costs.

C.P. Construction Co., Inc. has complied with the terms of the contract. A Notice of Completion has been prepared for filing with the San Bernardino County Recorder’s Office. The retention funds will be released following the 35-day lien period.
