BACKGROUND

As a municipal organization, the City of Chino is authorized to manage the risks associated with local government operations, including general liability and workers’ compensation claims. Since 2007, the City has used an insurance broker to purchase excess insurance for large potential losses that could affect its operations and services. The City's current insurance broker is AON Risk Insurance Services West.

As a matter of due diligence and in accordance with the City Council’s direction, staff submitted a variety of insurance applications and conducted a detailed review of the City’s insurance portfolio. Staff’s intent was to evaluate not only premium costs, but also key differences in coverage provisions, claims administration and control, membership characteristics, and available resources among the four Joint Powers Authorities.

ISSUES/ANALYSIS

Staff has requested a proposal from four Joint Powers Authorities (JPAs). The four JPAs include:

                     California Joint Powers Risk Management Authority (CJPRMA)

                     Public Risk Innovation, Solutions, and Management (PRISM)

                     California Intergovernmental Risk Authority (CIRA)

                     Public Entity Risk Management Authority (PERMA)

Each JPA conducted a comprehensive analysis of the City’s loss history and other applicable data to arrive at its recommendation for acceptance of the City’s potential membership.

Staff’s review compared all four JPAs using a comprehensive approach rather than relying solely on cost. Given the differences in coverage structures across the JPAs, the analysis focused on evaluating coverage scope, membership characteristics, as well as the range of value-added services offered by each JPA.

The analysis considered both the potential benefits and key considerations of participating in a JPA. Identified benefits include shared risk and reduced exposure to individual losses, legal and risk management resources; collectively negotiated coverage terms; and opportunities for member governance and oversight. Considerations include shared liability for losses incurred by other member agencies; the potential for increased contributions or assessments; reduced individualized control; and exit provisions that may require advance notice.

It is recommended the City Council receive the presentation on the JPA options and provide direction to staff to proceed further with evaluation of one or more JPAs for potential future participation.
