BACKGROUND
On June 20, 2022, the Planning Commission held a public hearing at the request of the developer regarding applications submitted for Site Approval PL21-0004, Tentative Parcel Map No. 20348, and Special Conditional Use Permit PL21-0005 for the construction of The Campus at College Park development within the Mixed-Use land use designation of the College Park Specific Plan area, generally located north of Eucalyptus Avenue, west of Satterfield Way, south of Notre Dame Avenue, and east of Oaks Avenue (Exhibit A).
Tentative Parcel Map No. 20348 proposes to subdivide the 7.53-acre project site into two parcels for the development of the proposed mixed-use development consisting of a commercial center and a separate church. The mixed-use development is known as The Campus at College Park. The commercial center component of the mixed-use development is proposed to be located on a 3.74-acre parcel on the northwest side of the project site and the church will be located on a 3.79-acre parcel on the southeast side of the project site.
The Campus at College Park project is proposed on the last remaining mixed-use property within the College Park Specific Plan area. The commercial center component is comprised of three two-story buildings, designed to front along Oaks Avenue, the roundabout, and a small portion of Eucalyptus Avenue. The church project site is comprised of three single-story buildings surrounding an interior courtyard.
The development of the project site is proposed to occur in two phases. The first phase will be dedicated to the construction of the church and Building A of the commercial center. The second phase of the project will include the remaining commercial buildings (Buildings B & C). The applicant anticipates construction of the first phase to begin by the end of this year and the second phase between 12 to 24 months after completion of the first phase.
After extensive discussion and deliberation, including discussions with the developer, the Planning Commission denied the project, specifically by failing to adopt any motion for or against approval of the project. Because no motion was passed, no findings were made, and no resolution was adopted. The applicant then appealed to the City Council and requested that the appeal hearing be postponed until September 6, 2022, to allow both the applicant and staff time to evaluate the issues brought up at the Planning Commission hearing.
Although the Planning Commission did not adopt a written resolution explaining the reasons why the project was not approved, two primary concerns were discussed during the Planning Commission’s deliberations, which include traffic & pedestrian safety and frontage improvements. Consequently, at the appeal hearing, staff addressed the traffic and safety concerns and adequately addressed the conditions imposed on the project as presented to the Planning Commission. The City Council adopted Resolution No. 2022-056 granting the appeal and thereby approving The Campus at College Park development project.
The Engineering Conditions of Approval (COA) for The Campus at College Park development require public improvements including, but not limited to curb, gutter, sidewalk, streetlights, asphalt concrete pavement, median/parkway landscape, sewer, water, recycled water, and drainage improvements. To guarantee the completion of these public improvements, the developer is required to enter into a Subdivision Improvement Agreement and obtain the necessary securities for the improvements.
ISSUES/ANALYSIS
The requirements made at the time of tentative map approval have been met by the execution of the Subdivision Improvement Agreements for Parcel Map No. 20348 and by posting the necessary securities to guarantee the construction of public improvements conditioned for The Campus at College Park development. The City Attorney reviewed and approved the Subdivision Improvement Agreement and respective securities, which is attached as Exhibit B. Therefore, it staff recommends that the City Council approve Parcel Map No. 20348.
It should be further noted, that the conditions of approval for the project require the developer to process a vacation for the right of way along Notre Dame Avenue adjacent to the site. This could have been accomplished through the Parcel Map; however, at the developer’s request, it was determined that in the essence of time, the vacation of the right of way could be processed through a separate instrument. Therefore, the vacation of right of way along Notre Dame will be brought back to the City Council for consideration at a later date.
