BACKGROUND
For several years, the Chino Police Department has directly participated in investigations or prosecutions that have resulted in a federal forfeiture and, therefore, an equitable share of the net proceeds of the forfeiture is returned to the city. Forfeiture funds can only be designated for law enforcement use and must be used to increase or supplement the resources of the receiving law enforcement agency. Forfeiture funds cannot be used to replace the resources of the Department.
ISSUES/ANALYSIS
The SWAT team's current rifles are vital tools ensuring officer safety while responding to high-stress situations and have surpassed their designated maintenance cycle in terms of round count. The rifles have been in service since 2019 and have been fired over 20,000 times. This overuse has led to visible wear and tear, impacting the overall reliability, accuracy, and safety of the rifles. Furthermore, specific components within the upper receiver assemblies, including bolts, barrels, and gas systems, have reached the end of their operational life. These factors collectively contribute to compromised functionality, posing potential risks during critical operations.
Existing SWAT rifle suppressors suffer from issues related to durability, “blowback” of noxious fumes exposure to carbon monoxide, hydrogen cyanide, and ammonia, and overall service life of the suppressor. Damaged suppressors can jeopardize the safety of law enforcement officers and compromise mission success. Addressing these concerns is crucial for enhancing the operational capabilities of SWAT teams. The following items are requested for purchase:
• Daniel Defense Mk18RIII (Upper Receiver and Included Parts)
• Radian Raptor SD charging handle
• HUXWRX flash hider
• HUXWRX Flow 556k suppressor
• HUXWRX FLOW 762 and muzzle brake
• Raptor-SD Charging handle AR10
The rifles were originally purchased with asset forfeiture funds and the listed parts are being replaced with the use of asset forfeiture funds. The timing of replacement of this type of equipment varies depending on how much the item is used and any unexpected failures or issues that arise. These parts need to be replaced because they have exceeded their lifespan, and funds were never allocated in the budget for this purchase.
Staff sought quotes and received prices that are less than the $10,000 per item. Therefore, per Municipal Code Chapter 3.32.070 Section B, the purchase may be made without competitive bidding. Staff requests that the City Council approve the use of Asset Forfeiture funds to purchase the upgraded rifle upper receiver, rifle suppressor and associated equipment in the amount of $42,698.37 (inclusive of tax and shipping).
By investing in this critical safety equipment, Chino Police Officers can be better equipped to effectively respond to the escalating dangers inherent in law enforcement duties, ultimately safeguarding both officers and the communities they serve.
