BACKGROUND

The applicant/property owner is requesting approval of Parcel Map No. 21008 to subdivide the existing residential property located at the southeast corner of Telephone Avenue and Walnut Avenue, at 12507 Telephone Avenue. The subject property consists of approximately 0.332 gross acres and is proposed to be subdivided into two residential parcels pursuant to Senate Bill 9 (SB 9), the Housing Opportunity and More Efficiency (HOME) Act, which became effective on January 1, 2022, and Government Code Section 66411.7. The proposed map includes Parcel 1 containing approximately 6,395 square feet net and Parcel 2 containing approximately 6,325 square feet net, together with associated right-of-way dedication along Walnut Avenue, as depicted on the Tentative Parcel Map attached as Exhibit A.

 

The request is limited solely to the subdivision of the property through an Urban Lot Split. No residential development, grading, building permits, or construction approvals are included as part of this application. Any future development on either parcel would require separate City review and approval through applicable planning, engineering, and building permit processes.

 

ISSUES/ANALYSIS

 

Staff reviewed Parcel Map No. 21008 for consistency with the provisions of Senate Bill 9, the Subdivision Map Act, and applicable objective City standards.

 

The proposed Urban Lot Split qualifies for ministerial approval because the site is located within a qualifying residential zoning district, the subdivision creates no more than two parcels, and the proposed lots are roughly equal in size. The resulting parcels substantially comply with applicable SB 9 requirements, and the application is limited to an Urban Lot Split pursuant to Government Code Section 66411.7.

 

Public Works staff have reviewed the proposed Parcel Map No. 21008 and confirmed that all Public Works Conditions of Approval (COA) applicable to the final map have been satisfied. The required rightofway dedication along Walnut Avenue has been incorporated into the map, and no outstanding Public Works comments or corrections remain. Staff have determined that the final parcel map conforms to the Subdivision Map Act and applicable City standards. The map is now ready for City Council approval and subsequent recording with the San Bernardino County Recorder-Clerk.
