RECOMMENDATION
Approve Resolution No. 2024-037 waiving the permit fees, plan check fees, and inspection fees for the Placentia Court Sewer Line Project located within the City's Sphere of Influence at 12594 Roswell Avenue; and authorize the City Manager to execute all the necessary documents on behalf of the City.

FISCAL IMPACT
The estimated costs for plan check services amount to approximately $8,808, and these services were carried out by the City's contracted plan check consultant. There are adequate funds available within the existing contract to cover these expenses. Regarding inspections and necessary permits, which are estimated at around $7,000, these will be provided as in-kind services by City staff.
However, despite utilizing in-kind services for inspections and permits, the City anticipates a shortfall of $15,808 in General Fund revenues.

BACKGROUND
The Sri Sairam Mandir Temple Project, located at 12594 Roswell Avenue within the City’s Sphere of Influence (“SOI”), received approval from the County of San Bernardino (“County”) on December 29, 2020. This project entails the construction of a two-story place of worship spanning 32,400 square feet, along with a 4,000 square-foot caretaker's unit, all on a 4.93-acre lot.
Located in the City’s RD2 (Residential, 2 units/acre) zoning per the General Plan, the project aligns with a land use designation intended for semi-rural, large-lot residential development, accommodating up to two dwelling units per acre and allowing for places of worship. During the County’s entitlement process, City staff reviewed preliminary plans and provided feedback to address inconsistencies with the City’s development standards.
In 2022, the project applicant approached City staff to request sanitary sewer service. Upon evaluation, it was determined that deviating from the City’s sewer service policy to accommodate this project would necessitate the design and construction of a 750 linear foot, 8-inch sewer main on Placentia Court, connecting to the City’s existing sewer main on East End Avenue. This infrastructure enhancement represents a significant financial commitment upward of $250,000 exceeding standard project requirements. The new sewer line would not only benefit the temple project but also offer connectivity for existing homes on Placentia Court. It is important to highlight that the applicant conducted a sewer study, which determined that the existing downstream facilities are sufficient to accommodate the additional flow resulting from the proposed temple and the current residents on Placentia Court.
On September 19, 2023, the City Council adopted Resolution 2023-055, approving a variance from the City’s established sewer service policy. This was conditioned upon the execution of a Covenant Agreement to Annex for Sanitary Sewer Service, allowing this project to proceed with sewer service in exchange for constructing the sewer line on Placentia Court.
On November 15, 2023, the Local Agency Formation Commission for San Bernardino County (“LAFCO”) conducted a public hearing and approved the City's application for an extension of sewer service with Resolution No. 3385. Subsequently, the Covenant Agreement to Annex was officially recorded in Official Records San Bernardino County on December 21, 2023.
ISSUES/ANALYSIS
The applicant requested that the City exempt the permit fees, plan check fees, and inspection fees, citing its nonprofit status. The project proposed by the applicant offers significant advantages to both the City and the residents, who stand to benefit directly from the new sewer line. This infrastructure is crucial given that the existing backbone and local sewer infrastructure in the SOI is currently unfunded.
The sewer design is now complete. Estimated costs for plan check services amount to approximately $8,808, with additional estimates totaling around $7,000 for inspection and necessary permits.
Therefore, it is staff’s recommendation to the City Council to approve Resolution No. 2024-037 waiving the permit fees, plan check fees, and inspection fees for the Placentia Court Sewer Line Project located within the City's Sphere of Influence at 12594 Roswell Avenue; and authorize the City Manager to execute all the necessary documents on behalf of the City.
