RECOMMENDATION
1) Accept public improvements as complete for Tract Map No. 20166; 2) authorize release of the performance bond and initiate the warranty bond; and 3) authorize the City Manager to execute the necessary documents on behalf of the City.

BACKGROUND
On August 5, 2019, the Planning Commission approved Chino Preserve Development Corporation’s (master developer in The Preserve) applications for Master Site Approval and Tentative Tract Map No. 20164, an “A” level subdivision for conveyance purposes and the master plan authorizing up to 388 residential units (the Block 4 Project). An “A” level subdivision functions as the master-level map for a project, establishing the overall planning areas, circulation network, and development framework, and allowing future “B” level tentative tract maps to be processed consistent with the approved master plan. The Block 4 Project is generally located at the north east corner of Hellman Avenue and Legacy Park Street. (Exhibit A)
Tract Map No. 20164 created nine numbered lots and twelve lettered lots to establish the planning areas and support six future “B” level tentative tract maps. As part of the Block 4 approvals, Tentative Tract Maps 20165, 20166, 20167, 20168, 20248, and 20249 were subsequently approved to allow development by guest homebuilders.
KB Homes Coastal, Inc. (“Builder”) purchased Tract No. 20166, a “B” level map authorizing development of 69 residential units on approximately 9.06 adjusted gross acres.
The Engineering Conditions of Approval (“COA”) for Tract Map No. 20166 required the Builder to design and construct certain public improvements on Reflection Street, Forerunner Court, Pacesetter Court, Searcher Street, and Globetrotter Avenue, including, but not limited to, sidewalk, curb ramps, asphalt concrete overlay, streetlights, parkway landscaping, signing and striping, sewer, storm drain, and domestic water improvements. To secure these obligations, the Builder executed a Subdivision Improvement Agreement and posted the required securities, which the City Council approved on July 20, 2021 (Exhibit B). All costs associated with the design and construction of the required improvements were fully borne by the applicant; therefore, there is no direct fiscal impact to the City.
Tract Map No. 20166 is included in the Settlement Agreement approved by the City Council on November 15, 2022. This tract falls under Category C, which applies to parcels approved on or after January 1, 2017. Under Category C, the Builder must comply with the City’s ADA Policy on Pedestrian Facilities (adopted December 3, 2019) per the settlement agreement and the ADA Policy at that time. When all improvements are properly constructed and meet ADA requirements, the City Council will accept them as complete.
The public improvements for this project were completed in accordance with the approved plans and to the satisfaction of Public Works staff. The project reached substantial completion in May 2025. Between May 2025 and February 2026, the contractor and project manager coordinated with the City’s project engineer to address various administrative items included in the final punch list to close out the project, including as-built drawings, grading certificate, compaction report, CAD/GIS files, and backflow certification. All outstanding punch list items have since been completed to the City’s satisfaction.
ISSUES/ANALYSIS
The public improvements being accepted by the City of Chino, as described above, are included as shown on Exhibit C. The public improvements completed have been constructed in compliance with the City’s standards/specifications, including accessibility requirements, and to the satisfaction of the Public Works Inspector. All public improvements that were part of the COA for this project were fully funded by the Builder.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the Builder will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain. The following maintenance obligations will commence following acceptance of the public improvements. For clarity, the Preserve Master Maintenance Corporation (PMMC) will be responsible for the maintenance of the public streetlights:
