RECOMMENDATION
1) Appropriate $609,291 from the Transportation Fund Balance 320 for the Traffic Signal Installation - Eucalyptus Avenue at Fern Avenue Project (TR240); 2) reduce the project budget by $609,291 from the Bridges/Signals/Thoroughfare (220) Development Impact Fee fund.; and 3) authorize the City Manager to execute all necessary documents on behalf of the City.

FISCAL IMPACT
There is no change in the total project budget. The appropriation of $609,291 will come from the available Transportation Fund Balance, which had previously received a developer fair share contribution of $553,500 and the remaining accessibility remediation settlement agreement of $55,791 for this project, account 3201000-59358. This appropriation will also result in an increase to the Fund 220 fund balance by $609,291 due to the removal of its budget. The total project budget will remain at $1,272,029.01.

BACKGROUND
On May 7, 2024, the City Council awarded a construction contract to Elecnor Belco Electric, Inc., for the Traffic Signal Installation - Eucalyptus Avenue at Fern Avenue Project (TR240) for $1,146,360 and a contingency amount of $114,636. On Thursday, March 6, 2025, substantial completion of improvements was completed, and the traffic signal was activated and is now fully operational. Obsolete streetlight removal, landscaping, and minor punch-list items remain before the project will be brought back to the City Council for Notice of Completion. Staff is working with the contractor to complete the project before the end of the fiscal year. Minor change orders within approved contingencies have been processed and staff anticipates completing the project under the current approved budget. Minor changes to the project included additional pavement rehabilitation and landscaping work.
As part of the conditions of approval for the adjacent University Park development, the developer Lennar Homes, was responsible for the installation of the traffic signal at Eucalyptus Avenue and Fern Avenue. However, after negotiating with the City, the City agreed to build the traffic signal in exchange for the development’s fair share contribution towards the traffic signal improvements. Additionally, under a separate settlement agreement with Lennar Homes, the developer agreed to contribute additional funds to the City to help cover the cost of bringing the previously installed substandard accessibility improvements into compliance with all City standards.
ISSUES/ANALYSIS
The installation of the traffic signal at Eucalyptus Avenue and Fern Avenue is outlined in the Citywide Development Impact Fee (DIF) Nexus Calculation Report. Upon project award, funding was secured through the Citywide Circulation (Bridges/Signals/Thoroughfare) System Development Impact Fee Fund (220) and Measure I (322) for pavement rehabilitation within the project limits.
The scope of work for the new traffic signal included completing accessible pedestrian improvements at the intersection, such as installing sidewalks and new pedestrian ramps. The intersection is now fully accessible to pedestrians of all abilities.
In addition, outside the project scope, the ADA Coordinator, Public Works Inspector, Services Manager, and Project Engineer conducted an inspection of existing pedestrian improvements within the City’s right-of-way. Accessibility deficiencies identified during the inspection were addressed by Public Works Services staff, with repairs funded by the developer's accessibility remediation contributions.
Staff recommends that the City Council approve the appropriation of the developer’s traffic signal fair share contribution in the amount of $553,500, and the developer’s remaining accessibility remediation settlement funds in the amount of $55,791 for a total of $609,291 to the Traffic Signal Installation - Eucalyptus Avenue at Fern Avenue Project (TR240). Additionally, staff recommends a corresponding decrease of $609,291 from the Bridges/Signals/Thoroughfare (220) fund from the project budget.
