BACKGROUND

Osterkamp Trucking, Inc. (the “Applicant”) received Planning Commission approval of a Conditional Use Permit (CUP) from the City of Pomona in 1985 for a trucking facility and has been headquartered at 1350 East Philadelphia Street in the City of Pomona since 1986.  The existing business spans across the City of Pomona and City of Chino city boundary lines, with the main operations located within Pomona and a parking facility for the business located on an adjacent parcel in Chino. The applicant acquired two additional adjacent properties, totaling 4.87 net acres of land in the City of Chino for additional truck trailer parking and flatbed storage and submitted an application for a Special Conditional Use Permit (SCUP) on October 17, 2022, to establish the use.  The two parcels are generally vacant, except for three radio broadcast antenna towers and an unmanned building utilized for AM-radio transmission equipment.

Due to the existing business operations crossing city boundaries with Pomona and the proposed truck trailer parking in Chino, staff referred the application to the City of Pomona in December 2022.  The City of Pomona determined a modification to the existing CUP for Osterkamp Trucking would be required since current business operations were not consistent with the approved CUP and to allow for access through the Pomona facility to the proposed truck trailer storage in Chino. On July 10, 2024, the Pomona Planning Commission approved a modification to the existing CUP to bring the existing business operations into compliance with the CUP, allow for truck and trailer access over the Pomona/Chino City boundary, and to allow ingress/egress from Philadelphia Street in Pomona.  The applicant is now requesting approval of a SCUP to establish an outdoor yard for truck trailer parking and flatbed storage.

Proposed Use

The applicant is proposing to establish an outdoor yard for the parking of truck trailers and flatbeds on a generally vacant parcel of land, associated with Osterkamp Trucking.  The use is classified as outdoor storage of vehicles by the Chino Zoning Code, which requires approval of a SCUP. The proposed truck trailer and flatbed storage will serve as an extension to the Osterkamp Trucking business that is currently in operation in the City of Pomona and currently utilizes an adjacent parcel within Chino for additional truck trailer parking. The applicant is currently in possession of approximately 2,000 trailers across their operations, with parking occurring at various locations in the region.  The current business relies on double and triple stacking trailers on their existing site, which is inefficient for business operations.  As designed, the vacant parcel of land will provide for the parking of 108 truck trailers and flatbeds, allowing the business to relocate trailers that are currently double and triple stacked.  There will not be an increase of trucks accessing the site or additional trailer storage.  The proposed outdoor yard would instead facilitate the orderly storage of truck trailers and flatbeds.  Osterkamp Trucking currently operates 24-hour daily operations, with primary hauling hours occurring between 4:00 A.M. and 5:00 PM.

As mentioned in the background, the application was referred to the City of Pomona due to the business operations crossing city boundaries.  As a result, the Pomona Planning Commission approved an amendment to the existing CUP for the facility and placed several conditions of approval on the project to ensure the proposed yard will not result in an expansion of the existing trucking operation or an increase in the number of trucks accessing the site. To ensure the outdoor yard remains consistent with the approval granted by the Pomona Planning Commission, Planning Conditions of Approval Nos. 4.9.5 to 4.9.10 have been placed on the project. These conditions are summarized below.

•                     The outdoor yard shall remain in compliance with all conditions of approval placed by the City of Pomona on CUP-000395-2024 as authorized by Pomona Planning Commission Resolution Nos. 6201 and 8832.

•                     Should the existing property owner sell or lease the outdoor yard/trailer parking area, the existing SCUP will be deemed invalid and a new SCUP will be required to be submitted for review and approval.  Additionally, both the City of Chino and the City of Pomona shall be informed within 90 days of a transfer of ownership or lease.

•                     Access to the outdoor yard shall be from Philadelphia Street, no access is permitted from Mills Avenue.

•                     Truck trailers and flatbeds shall only be stored in designated, marked trailer stalls. A total of 108 truck trailer parking stalls results in a maximum of 108 truck trailers or flatbeds being permitted within the outdoor storage yard. This number shall serve as the “Baseline” trailer count, and any increase in this Baseline represents an expansion of use which requires modification to approvals from both the City of Pomona and the City of Chino.

•                     The facility may operate 24 hours daily, as defined, with primary hauling hours designated between 4:00 A.M. to 5:00 P.M., and secondary hauling hours between 5:00 P.M. to 4:00 AM.

Site Design and Landscaping

The proposed project involves paving and striping the two newly acquired parcels in Chino to provide parking and storage for truck trailers and flatbeds, with the goal of providing a safer and more efficient working environment. As designed, 108 truck spaces and 6 vehicular spaces will be added, providing a total of 114 total spaces. These additional parcels will allow for on-site vehicle storage, reducing the necessity for off-site storage and reducing traffic movements to the maintenance facility on-site. Access will be provided from Pomona via the parcels to the north.  Trucks will enter the outdoor yard from the westerly point of access to park trailers and exit at the easterly access points.  Drive aisles are generally 50 feet to 60 feet wide, and all new trailer stalls are located to provide safe access throughout the site, while not interfering with the existing radio broadcast towers.  Additionally, on-site improvements will include landscaping, installing lighting, and erecting a 10-foot-high wrought iron fence around the perimeter for security.  Video surveillance equipment will be installed within the outdoor yard and will be accessible by the Chino Police Department’s Real Time Crime Center.

The project site exceeds the 10 percent landscape coverage requirement of the M2 Zoning District by providing a landscape coverage of 18.5 percent.  Landscaping is generally located around the perimeter of the site, around the radio broadcast towers, and at the existing unmanned radio building and consists of a mix of drought tolerant groundcover, shrubs and trees. A variety of landscaping will be planted adjacent to the fence along the perimeter with a row of Brachychiton Populneus Bottle trees, Canary Island Pine trees, and Hollyleaf Cherry shrubs, planted to serve as a buffer from Mills Avenue and the San Antonio Creek Channel. Additional landscaped fingers are located throughout the site and a retention basin is provided.

Public Noticing

A 10-day notice was mailed to all property owners and occupants within a 300-foot radius of the project site. In addition, a notice was published in the Chino Champion on September 7, 2024, and the City sent information out on the City’s social media platforms. In response to the public notice, no comments have been received. The notice exceeds legal noticing requirements.

ENVIRONMENTAL REVIEW

In compliance with CEQA, pursuant to Guideline § 15332, Infill Development, the Project qualifies as being categorically exempt from CEQA and will have no significant impact on the environment. The Project site and the Project are consistent with the City’s General Plan designation and all applicable General Plan policies, and the zoning designation and regulations of the City. The Project site is located within City limits measuring no more than five acres and is substantially surrounded by urban uses. The Project site has no value as habitat for endangered, rare or threatened species as it consists of a 4.87 net acre site in a densely populated area and is surrounded by urban uses, including a major public street (Philadelphia Street). It has been determined the proposed scope of work does not represent an expansion of the trucking facility as the applicant is not seeking to increase the number of trailers with this proposed action, but instead to facilitate the orderly storage of existing trailers on properties it owns across two jurisdictions. The approval of the Project would not result in any significant impacts relating to traffic, noise, air quality, or water quality. The Project’s Conditions of Approval will ensure that the Project will not result in any significant effects related to traffic, noise, air quality, or water quality. There are no reasonably identifiable unusual circumstances that would cause significant effects on the environment.  The Project site can be adequately served by all required utilities and public services as all services and access to the Project will be conditioned to meet local standards and requirements. Furthermore, the Planning Commission has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, section 15300.2 apply to this Project.
