BACKGROUND
On August 5, 2019, the Planning Commission approved Chino Preserve Development Corporation’s application for PL18-0012 (Master Site Approval) and PL18-0013 (Tentative Tract Map No. 20164) an “A” level master plan and subdivision for conveyance purposes of a 54.78 gross acre (55.86 adjusted gross acres) project site for the development of 388 residential units at an overall density of 6.95 dwelling units per acre in the LDR (Low Density Residential) land use designation. This project is generally located south of Pine Avenue, west of Hellman Avenue, and north and east of Chino Corona Road for what is known as the South of Pine area in The Preserve Specific Plan (Exhibit 1).
As part of the Engineering Conditions of Approval (COA) associated with the approved subdivision for Tract Map No. 20164, Chino Preserve Development Corporation was required to design and construct certain public improvements necessary to expand and support backbone infrastructure systems, including potable water facilities, roadway improvements, sanitary sewer facilities, storm drain infrastructure, and other related public improvements.
To guarantee completion of the required public improvements associated with Tract Map No. 20164, the developer executed a Subdivision Improvement Agreement (SIA) and posted the required securities for construction of the public improvements. The SIA and associated securities were approved by the City Council on July 21, 2020 (Exhibit B). All costs associated with the design and construction of the required improvements are borne solely by developer; therefore, there is no direct fiscal impact to the City.
The public improvements for this project were completed in accordance with the approved plans and to the satisfaction of Public Works staff. The project reached substantial completion in November 2022 and subsequently requested a bond reduction, which was granted by the City. Following substantial completion, the developer continued to coordinate and complete various offsite improvements associated with the guest builders. These improvements delayed completion of the remaining cap paving and final signing ang striping, which were ultimately completed in July 2026.
Between November 2022 and July 2026 the contractor and project manager coordinated with the City’s project engineer to address various administrative items included in the final punch list to close out the project, including centerline ties, as-built drawings, compaction reports, and CAD/GIS files. All outstanding punch list items have since been submitted and completed to the City’s satisfaction.
ISSUES/ANALYSIS
The public improvements to be accepted by the City of Chino, as described above, are depicted in Exhibit C. The public improvements completed have been constructed in compliance with the City’s standards and specifications to the satisfaction of the Public Works Inspector. All public improvements that were part of the COA for this project were fully funded by the developer.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain.
Accessibility
The pedestrian improvements constructed as part of the project, including sidewalks, curb ramps, and crosswalks, were inspected by City staff in the field and determined to be compliant with applicable accessibility requirements and City standards.
