BACKGROUND
In 2003, the Planning Commission approved Chino Development Corporation’s (CDC) application for an “A” level Master Site Approval and Tract Map Nos. 16418 and 16419 to subdivide 370 acres of land to establish large parcels and major street systems for future development within the area generally located south of Kimball Avenue between Hellman and Mill Creek Avenues, north of Pine Avenue for what is known as Phases 1 and 2 of The Preserve Specific Plan.
On May 20, 2019, the Planning Commission approved Tentative Tract Map No. 20223 (an “A” level map) to further master plan and subdivide 10.12 adjusted gross acres of land for two developments (Tract Map Nos. 20231 and 20232) totaling 176 residential dwelling units within Lot 11 of Phase 2, which is located east of West Preserve Loop, south of Garden Park Street and west of Main Street (Exhibit A).
At the same Planning Commission meeting, William Lyon Homes received approval to develop the west portion of Lot 11 known as Tract Map No. 20232. Subsequently, William Lyon Homes was acquired by Taylor Morrison Communities (“Taylor Morrison”). In addition, CDC requested approval to develop units on the remaining portion of Lot 11 known as Tract Map No. 20231, which was acquired by Lennar Homes of California, Inc. (“Lennar”).
The Conditions of Approval ("COA") for the “A” level map required CDC to complete the backbone water improvements for the “B” level maps. The public improvements completed by CDC necessitated the execution of a Subdivision Improvement Agreement and posting securities that the City Council approved on September 3, 2019 (Exhibit B). It should be noted that the costs associated with the design and construction of the required public improvements are completely offset by the developer. There is no direct fiscal impact on the City.
ISSUES/ANALYSIS
The public improvements are complete and have been constructed to the satisfaction of the City Engineer. The public improvements that are being accepted by the City of Chino include 8” in-tract potable water lines. With City Council's approval, the City's maintenance obligations will commence for the water improvements.
The developer fully funded all public improvements that were part of the condition of the project.
All required development-related fees have been paid and security for a one-year warranty period has been submitted. Under the warranty bond obligation, the developer will correct any defects found within one-year of City Council’s acceptance of the project.
