BACKGROUND
The Planning Commission conditionally approved Site Approval PL17-0112 and Tentative Tract Map. No 18903 on August 20, 2018, for a development of 38 single-family homes. This development is generally located north of Chino Avenue between Pipeline and Norton Avenues, as shown in Exhibit A.
The Conditions of Approval ("COA") required public improvements along the project’s frontage between Pipeline and Norton Avenues north of Chino Avenue as well as in-tract improvements which include curb, gutter, sidewalk, curb ramps, signing & striping, drive approaches, street paving, sewer, storm drain, and domestic water improvements.
On March 19, 2024, the City Council accepted the storm drain improvements associated with the development and authorized an immediate reimbursement of $1,178,914 to the developer for the construction of the master-planned storm drain, thus fulfilling the terms of the Construction Credit/Reimbursement Agreement. However, the final acceptance of the remaining public improvements was postponed due to unresolved pavement cracking issues on Rushmore Court, Ryan Way, and Denali Lane.
On June 10, 2024, staff presented a proposal to the Infrastructure Committee to pilot Type II Rubberized Emulsion Aggregate Slurry (REAS), a material technology that has been successfully used in nearby cities. REAS meets industry standards and provides enhanced durability and crack coverage. It can be reapplied as necessary to maintain street integrity and aesthetics. The Infrastructure Committee supported the staff's recommendation to proceed with the pilot project, On July 31, 2024, City Council awarded a professional services agreement to Petrochem Materials Innovation, LLC (PMI) for this project.
PMI completed the REAS application on Rushmore Court, Ryan Way, and Denali Lane on August 15, 2024. The streets were temporarily closed during the day for the work but reopened to residents that evening after REAS had been applied and allowed sufficient curing time before vehicle traffic was permitted. Public Works staff restriped the roadways on August 20, 2024, after the REAS had adequately cured.
ISSUES/ANALYSIS
Meritage Homes of California, the developer, has placed $121,252.68 into the City's account. This sum is designated for the initial application of REAS, covering the City staff's efforts, with the remainder allocated for future expenses related to a second application of REAS on the specified streets. Any remaining funds after the project's completion will be reserved for the future second application of REAS moving into the future.
The public improvements are now complete and have been constructed to the satisfaction of the City Engineer and the Public Works Director. The improvements that are being accepted have been satisfactorily constructed to meet all applicable accessibility requirements. The developer fully funded all public improvements that were part of the conditions of approval for the project.
All necessary development-related fees have been paid, and security for a one-year warranty period has been provided. Under the terms of the warranty bond, the developer is responsible for correcting any defects identified within one year of the City Council’s acceptance of the project, as outlined in the Subdivision Improvement Agreement. Additionally, PMI offers a 7-year warranty guaranteeing a prompt response to address any street degradation issues.
