BACKGROUND
On November 1, 2019, the Planning Commission approved Tentative Parcel Map No. 20058 (PL18-0112) and Site Approval (PL18-0113) for the construction of two concrete tilt-up warehouse/office buildings (“Project”). The Project is located at 5240 Eucalyptus Ave and 5280 Eucalyptus Ave, on the northwest corner of Central and Eucalyptus Avenues (Exhibit A).
The Conditions of Approval (“COA”) for this Project required the Applicant to complete certain public improvements along the project’s frontage, which include, but are not limited to, curb and gutter, driveway approaches, parkway landscape, sidewalk, undergrounding of dry utilities, crosswalks, curb ramps, traffic signal mods, streetlights, domestic water lateral, recycled water lateral and sewer lateral improvements.
The developer started the plan check process in February 2020 and underwent a few rounds of plan checks for onsite and offsite improvements until October 2020. During the plan check process, it was determined that additional offsite improvements were desired by the City. Those additional improvements included constructing a sidewalk extension on Central Ave along the project frontage from the project site to College Park Ave, to the north. With these changes, the conditions of approval were revised, and a time extension was provided on October 21, 2020 by City staff, since the final map was not completed or recorded then. The plan check resumed for both onsite and offsite improvements. Construction for the onsite improvements began in July 2021 and, subsequently, construction for the offsite improvements in September 2022. During construction, the City and the Applicant met to discuss the City’s condition to provide sidewalk connectivity above and beyond the project’s frontage. The applicant contended that extending the sidewalk to College Park Avenue and relocating various conflicting utilities would be cost prohibitive to undertake and would result in project delays. As a result, city staff agreed to allow the applicant to adhere to the original condition, which requires sidewalk along the property frontage.
The public improvements necessitated the execution of a Subdivision Improvement Agreement and the posting of securities approved by City Council on October 5, 2021 (Exhibit B).
The COA additionally required that the owner annex the property to the City’s Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 85) for public streetlight maintenance along the project’s frontage, within the right-of way. The public hearing for the annexation was held on January 4, 2022, which was unanimously approved by the City Council the same night.
ISSUES/ANALYSIS
The public improvements described above are being accepted by the City of Chino as complete and have been constructed to the satisfaction of the City Engineer. Exhibit C, titled “Infrastructure Exhibit”, shows the public improvements being accepted.
All public improvements that were part of the condition of the Project were fully funded by the Applicant/Developer.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain. The following maintenance obligations will commence following acceptance of the public improvements:
