RECOMMENDATION
1) Accept public improvements as complete for Site Approval PL20-0029; 2) authorize release of the performance bond and initiate the warranty bond; and 3) authorize the City Manager to execute the necessary documents on behalf of the City.

BACKGROUND
Yorba XC, LLC (developer) entered into an agreement with the Chino Valley Unified School District (CVUSD) to construct the district’s new administrative office building in exchange for a long-term ground lease on an adjacent piece of industrial property to the east, owned by CVUSD. Subsequently, the developer submitted applications to develop two separate Site Approvals in accordance with the agreement. Project PL20-0026 is for the construction of a two-story administrative office building that was built at 13461 Ramona Avenue. The project was accepted by the City Council as complete on July 15, 2025. Project PL20-0029 is the second site, which involves the construction of a speculative warehouse/distribution building at 13404 Yorba Avenue (Exhibit A).
The Engineering Conditions of Approval (“COA”) for PL20-0029 required the developer to design and construct certain public improvements on the perimeter of Yorba Avenue including, but not limited to, sidewalk, curb ramps, asphalt concrete overlay, streetlights, parkway landscaping, signing and striping, sewer, storm drain and domestic water improvements. The public improvements completed by the developer necessitated the execution of a Public Improvement Agreement and posting securities that the City Council approved on July 5, 2022 (Exhibit B). It should be noted that the costs associated with the design and construction of the required public improvements are completely offset by the applicant. There is no direct fiscal impact on the City.
The conditions of approval required the owner annex the property to the City’s Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 91) for public streetlight maintenance along the project’s frontage, within the right-of-way.
On July 5, 2022, the City Council approved Resolution 2022-039, which declared the City’s intention to annex the property into Landscape and Lighting District (LLD) No. 2002-1 (Annexation/Zone No. 91) and approved the Engineer’s Report, which estimates the annual assessment to be levied from the property for streetlight maintenance. By way of ballots mailed to the property owner(s), the property owner(s) are requested to register their support or protest for the annexation to Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 91). On December 6, 2022, the City Council held a public hearing and approved Resolution 2022-081 ordering the annexation into Landscape and Lighting District No. 2002-1 (Annexation/Zone No. 91).
The public improvements for this project were completed in accordance with the approved plans and to the satisfaction of Public Works staff. The project reached substantial completion in March 2025. Between March and August 2025, the contractor and project manager coordinated with the City’s project engineer to address various administrative items included in the final punch list to close out the project file, including as-built drawings, grading certificate, compaction report, CAD/GIS files, and backflow certification. All outstanding punch list items have since been completed to the City’s satisfaction.
ISSUES/ANALYSIS
The public improvements being accepted by the City of Chino, as described above, are included as shown on Exhibit C. The public improvements completed have been constructed in compliance with the City’s standards/specifications, including accessibility requirements, and to the satisfaction of the Public Works Inspector. All public improvements that were part of the COA for this project were fully funded by the developer.
Security for a one-year warranty period has been submitted to the City. Under the warranty bond obligation, the developer will correct any defects found within one year of the City Council’s acceptance of the Project. Also, upon completion and final acceptance, the public improvements shall become the sole exclusive property of the City to operate and maintain. The following maintenance obligations will commence following acceptance of the public improvements:
