BACKGROUND
On July 6, 2021, Loyola Properties and the Pietersma Family Trust, referred to as Falloncrest (“Owners”) entered into a Development Agreement with the City. The Development Agreement was executed to vest certain land use entitlements so that the Owners could successfully improve and develop the property generally located on the north side of Pine Avenue, between East and West Preserve Loop Roads. In total, the property encompasses approximately 100 acres.
To date, two of the three phases of the Falloncrest at The Preserve Master Plan are built or under construction. The final phase is located in the center of the site and is currently being marketed to residential and commercial builders by the Owners. The Owners have also submitted proposed amendments to the General Plan and The Preserve Specific Plan to facilitate development of the final phase, which are scheduled to be considered by the City Council at a future meeting. The proposed amendments would reduce the allowable residential density within Phase 3 by changing the existing CC30 (Community Core, 30 dwelling units per acre) land use designation to CC16 (Community Core, 16 dwelling units per acre). The proposed change would not increase or decrease the maximum number of residential units permitted within Phase 3. The reduction in density would require a greater amount of land to accommodate the residential development to maintain the overall number of units planned within Phase 3. As a result, the amount of land available for commercial development within Phase 3 would be reduced. At full buildout, the Falloncrest development is entitled to construct up to 1,139 residential units and, under the originally approved Master Plan (PL20-0011), up to 155,194 square feet of commercial uses.
ISSUES/ANALYSIS
The Falloncrest Development Agreement has now been in place for over five years. Pursuant to Article 12 of the Development Agreement, an annual review of terms and conditions, along with the production of an Annual Monitoring Report by the Owner is required. Upon receipt of the monitoring report, City staff is to conduct an analysis of the report to determine its accuracy and then submit a report to the City Council indicating compliance or lack of compliance with the terms and conditions of the Development Agreement. The Owners have the right to request a formal Certificate of Compliance from the City Council.
In June 2026, the Owners submitted the annual monitoring report to the City (Exhibit “A”) and requested a Certificate of Agreement Compliance to affirm that they are still in compliance with all applicable Development Agreement obligations. Based on the review of the annual monitoring report, staff has determined that the owners are in compliance with all of the requirements of the Development Agreement for the period from August 5, 2025, to August 5, 2026. The Development Agreement obligations are listed in Exhibit “A” with the current status.
