RECOMMENDATION

title

Approve, by motion of the Planning Commission, a one-year time extension for PL17-0106 (Tentative Tract Map No. 18846).

BACKGROUND

The applicant, Trumark Homes, received approval by the Planning Commission on August 19, 2019, for PL17-0106 (TTM 18846), an “A” level tentative tract map for the Rancho Miramonte development located at the southeast corner of Chino-Corona Road and Cucamonga Avenue, within The Preserve Specific Plan.  TTM 18846 subdivided the property into 24 numbered lots and 19 lettered lots for conveyance purposes.  In addition to establishing new property lines, TTM 18846 established the backbone street system for the community, allowed for mass grading of the site, and set aside 67 acres of land for habitat restoration and conservation.  The project site currently sits below the 566-foot flood inundation line, which will require the applicant to raise the site to allow for the future development.  The applicant is required to acquire all necessary permits and approvals from the United States Army Corps of Engineers (USACOE), which include an easement exchange to raise the buildable area above the 566-foot flood inundation line prior to any grading of the project site.

ISSUES/ANALYSIS

Per the Subdivision Map Act and the City’s Subdivision Ordinance, approval of a tentative tract map expires two years after Planning Commission approval if the final map has not been recorded. In response to the COVID-19 pandemic, the State Legislature passed AB1561 to extend housing entitlements that were effective prior to March 4, 2020 and set to expire before December 31, 2021.  An 18-month time extension was approved for the project on June 30, 2021, under the provisions of AB1561, extending the approval of PL17-0106 to February 19, 2023.  The Planning Commission approved a second time extension on November 16, 2022, extending approval of PL17-0106 to February 19, 2024.  Trumark Homes is now requesting approval of a one-year time extension to allow for additional time to coordinate with the USACOE on the necessary permits and approvals for the project.  If the request for the time extension is approved, approval of PL17-0106 would expire February 19, 2025.

Public Notice

A 10-day notice was mailed to all property owners within a 300-foot radius of the project site.  In addition, a notice was published in the Chino Champion on March 9, 2023, and the City posted information on the project on social media outlets.  In response to public notice, no comments have been received.  The notice exceeds legal noticing requirements.

ENVIRONMENTAL REVIEW

An Addendum to the Edgewater Communities Environmental Impact Report (EIR) (SCH No. 2006121093) for the Rancho Miramonte project was adopted on March 15, 2016 pursuant to Section 15164 of the California Environmental Quality Act (CEQA) Guidelines.  The project is within the scope of the EIR, which adequately describes the activity for the purposes of CEQA.
