BACKGROUND
On February 22, 2017, the Planning Commission approved PL16-0415 (Special Conditional Use Permit) to establish a 7-Eleven gas station and convenience market with a Type 20 Alcoholic Beverage Control (ABC) license for off-premise consumption of beer and wine for 7-Eleven. The 7-Eleven has been operating at this location since 2019 and offers a variety of convenience goods, foods, beverages and beer and wine. The applicant is now requesting to upgrade the existing Type 20 (Off-Sale Beer and wine) license to a Type 21 (Off-Sale General) license to allow the sale of distilled spirits in addition to beer and wine for off-site consumption.
ISSUES/ANALYSIS
The 7-Eleven gas station convenience market is located within an existing 3,130 square foot building. The convenience market includes grab-and-go items, beverages, beer and wine, and is now requesting approval to sell distilled spirits as part of the business operation. Currently the business has seven employees and operates three shifts per day, with one to three employees per shift. The store is open 24 hours a day. Approximately 32 square feet of floor space is dedicated to the display and storage of alcohol, which accounts for less than 1% of the total floor area. Additionally, the applicant estimates that the sale of beer, wine and distilled spirits will account for 21% of total sales. The Zoning Code has several provisions relating to the sale and display of beer, wine and distilled spirits for off-premise consumption that have been included as conditions of approval. These conditions address the sale, storage, and advertising of alcohol, and are sufficient to regulate the proposed sale of beer, wine and distilled spirits.
The applicant is applying with the California Department of Alcoholic Beverage Control (ABC) to upgrade its existing Type 20 (Off-Sale Beer and Wine) license to a Type 21 (Off-Sale General) license. Pursuant to the Business and Professions Code, a determination of Public Convenience or Necessity (PCN) may be required when there is an undue concentration of alcoholic beverage licenses within the applicable census tract and/or when the premises is located within a high crime reporting district. Census Tract 19.09 is authorized for two off-sale licenses and currently contains one off-sale license, the existing Type 20 license associated with the 7-Eleven at the project site. The proposed Type 21 license would replace the existing Type 20 license and would not increase the number of off-sale licenses within the census tract. Therefore, the proposed license would not result in an undue concentration of off-sale licenses.
The Chino Police Department reviewed crime statistics for the applicable crime reporting district and determined that the project site is not located within a high crime reporting district. The Police Department also reviewed the application for potential public safety impacts associated with the sale of alcohol for off-site consumption. The Police Department determined that the proposed upgrade to the ABC license is not anticipated to result in a significant impact on public safety with implementation of the project’s conditions of approval. The Police Department has no concerns with the request. Accordingly, the project site is neither located within a census tract with an undue concentration of off-sale licenses nor within a high crime reporting district; therefore, PCN findings are not required.
Public Noticing
A 10-day notice was mailed to all property owners within a 300-foot radius of the project site. In addition, a notice was published in the Chino Champion on October 10, 2026. In response to the public notice, no comments have been received. The notice meets legal noticing requirements.
ENVIRONMENTAL REVIEW
The proposed Project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301, Existing Facilities. Furthermore, none of the exemptions to the categorical exemptions set forth in the CEQA Guidelines 15300.2, apply to this project.
