RECOMMENDATION
1) Accept the CDBG Alley Improvements FY2023-24 Project (SN240) with CJ Concrete Construction, Inc., Contract No. 2026-194 as complete; 2) authorize the Director of Public Works to file the Notice of Completion on behalf of the City of Chino; and 3) authorize the release of retention funds following the 30-day period.

FISCAL IMPACT
This contract was completed within the City Council approved budget for SN240. All unused contract funds will be returned to the CDBG (550) fund balance.

BACKGROUND
The Community Development Block Grant (CDBG) Program supports community development activities to build stronger and more resilient communities. Activities may address needs such as infrastructure, economic development projects, public facilities installation, and public services. Annually, the City Council approves a one-year action plan to program the use of CDBG funding.
On May 2, 2023, City Council approved the establishment of the CDBG Alley Improvements FY2023-24 Project (SN240), and the use of CDBG funding in the amount of $219,256 for the Project through the FY2023-24 One-Year Action Plan.
On April 1, 2025, City Council approved an amendment to transfer $298,868.65 CDBG funds from the Community Garden Pumpkin Patch Project (PF253) to Project SN240 for a new total project budget of $518,124.65. These additional funds allowed for an update to the project scope to expand the pavement rehabilitation limits easterly to Monte Vista Avenue.
On October 21, 2025, City Council approved an amendment to the City’s annual CDBG action plan and approved a budget transfer of $31,500 from the Economic Development Façade Improvements Project (G6231) to project SN240 for a new project budget of $549,624.65.
On December 2, 2025, the City Council awarded Construction Contract No. 2026-194 for $407,955 to CJ Concrete Construction, Inc. for the construction of Project SN240 and approved a contingency amount of $40,795.50. Project SN240 scope of work included construction of concrete ribbon gutters, concrete alley entrances, curb and gutter, sidewalk, and pavement rehabilitation of the existing east-west alley south of D Street from Monte Vista Avenue to 5th Street.
ISSUES/ANALYSIS
All work has been completed per the terms of the original construction contract and approved change order. Change Order No. 1 included the final balancing change order addressing changes in quantities to reflect actual work performed.
CJ Concrete Construction, Inc. has complied with the terms of the contract which included reconstruction of alley approaches to meet Americans with Disabilities Act (ADA) standards. A Notice of Completion has been prepared for filing with the San Bernardino County Recorder’s Office. The retention funds will be released 30 days after recording.
