Approve Amendment No. 1 to the Cooperative Agreement between the City of Chino and the City of Chino Hills for the Chino Hills Parkway Street Rehabilitation Project; and authorize the City Manager to execute all necessary documents on behalf of the City.

FISCAL IMPACT
This amendment will increase the City’s cost share by $13,576. Sufficient funds are included in the Fiscal Year 2024-25 Capital Improvement Program for Project No. R7231.

BACKGROUND
On February 6, 2024, The City Council approved a Cooperative Agreement to establish cost sharing and reimbursement obligations with the City of Chino Hills for the Chino Hills Parkway Street Rehabilitation Project (R7231). The majority of the Project is located within the City of Chino Hills; therefore, Chino Hills acts as the lead agency and is responsible for all California Environmental Quality Act (CEQA) compliance, managing and directing all aspects of the Project, including retaining a qualified engineering consultant to design the Project, retaining a qualified general contractor through a competitive bidding process per applicable law, managing the construction contract, and overseeing construction of the Project through completion.
The Project scope includes pavement rehabilitation, curb ramp upgrades, installation of new video detection systems, and striping improvements within two segments of Chino Hills Parkway. As shown in Exhibit A, project limits for Segment 1 are entirely within City of Chino Hills boundary between Chino Hills’ northwest boundary and the intersection of Chino Hills Parkway at Carbon Canyon Road. Project limits for Segment 2 are between State Route 71 (SR-71) and Monte Vista Avenue. The jurisdictional boundary separating the City of Chino and City of Chino Hills is roughly located at the centerline of Chino Hills Parkway in Segment 2.
The Cooperative Agreement divides Project costs equitably between the Cities of Chino and Chino Hills. Each City’s obligational share is defined in the Agreement and summarized in the table below:

ISSUES/ANALYSIS
The Cooperative Agreement provides a mechanism for the City of Chino to reimburse the City of Chino Hills for its obligational share of professional fees and construction costs incurred by the City of Chino Hills to complete the project.
On February 28, 2023, City of Chino Hills contracted with BKF Engineers to provide professional engineering and design services for the Project. During the design phase, the City of Chino requested additional design services, including detailed curb ramp designs, traffic signal modifications, and additional survey work at the northwest and northeast corners of Chino Hills Parkway at Ramona Avenue, within City of Chino’s right-of-way to ensure compliance with the City’s Policy on Accessible Pedestrian Facilities. On July 19, 2024, BKF Engineers submitted a proposal to the City of Chino Hills in the amount of $13,576 to include these additional services. Amendment No. 1 to the Cooperative Agreement stipulates that City of Chino will be responsible for 100% of the costs associated with these additional services necessary to comply with the City’s Policy on Accessible Pedestrian Facilities.
At its City Council meeting held on November 12, 2024, the City of Chino Hills approved Amendment No. 1 to the Cooperative Agreement and an amendment to their professional services agreement with BKF Engineers in the amount of $13,576. Upon approval by the City of Chino City Council, and signed execution of Amendment No. 1, the City of Chino Hills can issue a notice to proceed for the additional design services. Design is anticipated to be completed within the first quarter of 2025 with construction estimated to begin summer 2025.
The attached Amendment No. 1 to the Cooperative Agreement has been reviewed and approved by the City Attorney as to form.
Therefore, staff recommends City Council approve Amendment No. 1 to the Cooperative Agreement with City of Chino Hills for the Chino Hills Parkway Pavement Rehabilitation Project (R7231).
